Defendant Hoang Anh Kiet (born in 2007, residing in Dong Lai village, Vinh Lai commune, Hai Phong) was prosecuted for violating regulations on road traffic participation, as prescribed in Clause 2, Article 260 of the Penal Code.
According to the indictment, at 7:20 p.m. on August 16, 2024, at km 40+ 250 in Dan An commune, Tu Ky district, Hai Duong province (old), Kiet did not have a driver's license and rode a SH motorbike without a license plate in the direction of Ninh Giang - Hai Duong city (old). Due to not paying attention and not reducing speed at the place where there were warning signs of danger, the newspaper intersected with a non-priority road, leading to the front wheel of a motorbike driven by the defendant colliding with the rear footrest of a bicycle driven by Ms. P.T.M (born in 1982, residing in My Duc village, Tan Ky commune, who was crossing the road). As a result, Ms. M was injured, with an injury rate of up to 99%.
At the trial, to clarify the details and evidence in the case, the prosecutor published evidence such as videos, images, scene diagrams, etc. to serve the questioning. Based on the evidence published in photos, along with questioning and debate at the trial, the prosecutor convincingly clarified the defendant's criminal acts.
Based on the proposal of the People's Procuracy, based on the nature and severity of the defendant's criminal acts, the Trial Council sentenced defendant Hoang Anh Kiet to 21 months in prison with a suspended sentence, and a probationary period of 36 months from the date of the first instance verdict.
