The defendants, Nguyen Duc Thuan (born in 2002, residing in Ngoc Lau village, Cam Giang commune, Hai Phong city) and Vi Van Phang (born in 1992, residing in Xim village, Quang Chieu commune, Thanh Hoa province) were tried for the crimes of "Illegal possession of narcotics" and "Organizing illegal use of narcotics" as prescribed in Clause 1, Article 249 and Clause 1, Article 255 of the Penal Code.
According to the indictment, at about 10:45 p.m. on April 15, 2025, in the cemetery area of Thinh Van residential area, Minh Duc ward, My Hao town, Hung Yen province (now Thuong Hong ward, Hung Yen province), Vi Van Phang and Nguyen Duc Thuan prepared heroin and organized illegal use for each other. After finishing use, Phang hid the remaining 0.255 grams of drugs that Thuan had just bought for use. At around 11pm the same day, on National Highway 5A in Mau Tai village, Phuc Dien commune, Cam Giang district (now Mau Tai village, Mao Dien commune, Hai Phong city), Phang was caught red-handed by Hai Duong Provincial Police and had his evidence confiscated.
In this case, Vi Van Phang was the initiator, money preparer, and drug hiding, so he played the first role; Nguyen Duc Thuan was the person who bought drugs, so he played the second role.
At the trial, the defendants confessed to their crimes. Based on the proposal of the People's Procuracy of Region 12 - Hai Phong City, the Trial Council sentenced defendant Nguyen Duc Thuan to 14 months in prison for the crime of Illegal possession of narcotics and 27 months in prison for the crime of Organizing illegal use of narcotics, the total sentence for the two crimes was 41 months in prison; sentenced defendant Vi Van Phang to 13 months in prison for the crime of Illegal possession of narcotics and 25 months in prison for the crime of Organizing illegal use of narcotics, the total sentence for the two crimes was 38 months in prison.
