Time to establish housing ownership

Article 12 of the Law on Housing 2023 stipulates the time of establishing housing ownership as follows:

1. In case of directly investing in housing construction, the time to establish housing ownership is the time to complete the construction of houses in accordance with the law on construction.

2. In case of buying and selling and buying houses but not in the case specified in Clause 4 of this Article, the time to establish housing ownership is the time of the buyer or the buyer has paid enough money to buy, rent and have handed over the house, unless otherwise agreed by the parties.

3. In case of capital contribution, donation or change of housing, the time of establishing the ownership of houses is the time when the receiving capital contributed, the recipient, the exchange party has been handed over the house from the capital contribution, the donor, the change of the house, except for the case of other agreements.

4. In case of buying and selling houses between investors of housing construction investment projects and buyers and buyers, the time to establish housing ownership is comply with the law on real estate business.

5. In case of inheriting housing, the time of establishing housing ownership shall comply with the provisions of civil law.

6. Other cases comply with the relevant law.

7. Housing transactions specified in Clauses 2, 3 and 4 of this Article must comply with the conditions of housing transactions and contracts must take effect in accordance with this Law.
