The defendants include Vu Thi Tham (born 1950), Nguyen Nhu Phung (born 1976), Nghiem Thi Thuy (born 1989, all residing in Thach Loi village, Cam Giang commune, Hai Phong) prosecuted for the crime of Property Destruction, according to Clause 1, Article 178 of the Penal Code.
According to the content of the Indictment of the People's Procuracy of Region 12, Vu Thi Tham and Nguyen Nhu Phung are mother and daughter. Nguyen Nhu Phung and Nghiem Thi Thuy lived together as husband and wife and lived in the same house with Tham. The land plot where Tham's family is living in Thach Loi village, Cam Giang commune borders the land plot of Mr. Vu Huu Can's family (born in 1972) and Ms. Nguyen Thi Thoa (born in 1972).
At about 7 am on June 12, 2025, Mr. Can hired a group of construction workers to build a wall behind the house separating it from the entrance to Tham's house. Tham's family believed that Mr. Can's family built the wall on the land area of their house, so they prevented it from being built, leading to arguments between Tham, Thuy, and Phung with Mr. Can and Mrs. Thoa.
At 11 am on the same day, when Mr. Can built a wall separating the walkway, Tham used his hand to push the wall, then used a hammer to demolish it. During this process, Nguyen Nhu Phung and Nghiem Thi Thuy continuously made provocative words, inciting Tham to demolish the wall. At about 1:30 pm on the same day, Tham had completely demolished the 2 walls built by Mr. Can.
At the trial, the Prosecutor presented images of a video recording the diễn biến of defendant Tham breaking the wall, defendants Thuy and Phung having words of incitement and assistance to defendant Tham.
Based on the proposal of the representative of the People's Procuracy of Region 12 - Hai Phong, the Trial Panel sentenced defendant Vu Thi Tham to 8 months of suspended imprisonment, probation period of 16 months; defendants Nguyen Nhu Phung and Nghiem Thi Thuy to 7 months of suspended imprisonment, probation period of 14 months, for the crime of "Destroying property" under Clause 1, Article 178 of the Penal Code.
