The Lao Dong Newspaper Legal Consulting Office replied:
Article 28 of the 2024 Trade Union Law (effective from July 1, 2025) stipulates the guarantee for trade union officials as follows:
1. In case the labor contract or employment contract expires and the employee is a non-professional union official who is in the labor contract term, the labor contract or employment contract shall be extended until the end of the labor contract term.
2. Employers must not unilaterally terminate the labor contract, work contracts, dismiss, resign or transfer other jobs for non -specialized trade union officials if there is no written agreement of the superior trade union directly. In case of failure to agree, the two parties must report to the competent agency or organization. After 30 days from the date of notifying the competent authorities and organizations, the employer has the right to decide and be responsible for his decision.
3. In case the employee is a part -time union official who is taken by the employer to terminate the labor contract, the work contract, forced the job or dismissed it illegally, the Trade Union shall request that the competent state agency intervenes or represent the law to sue the case in the Court to protect the legal rights and interests of the Trade Union officials, except for the case of the Trade Union cadres.
In case they cannot return to their old job, non-professional union officials will be supported by the Trade Union to find new jobs and during the period of job interruption, they will be supported with money from the trade union's financial resources according to the regulations of the Vietnam General Confederation of Labor.
Thus, from July 1, 2025, in cases where the labor contract or contract expires and the employee is a non-professional union official who is in the labor contract term, the labor contract or contract of work will be extended until the end of the labor contract term.
