Mr. Le Dinh Quang - Deputy Head of the Department of Legal Policy and Labor Relations (Vietnam General Confederation of Labor) said that Article 27 of the 2024 Trade Union Law (on ensuring conditions for trade union activities) stipulates: Part-time trade union officials are allowed to work 24 hours a month for grassroots trade union chairmen and vice chairmen; 12 hours of work per month for executive committee members, team leaders and deputy team leaders of trade union groups to work in trade union work and are paid by employers. Depending on the scale, type, and nature of the agency, organization, unit, or enterprise, the grassroots union executive committee and the employer will agree on the additional time.
Part-time union officials are entitled to take a day off from work and receive salary paid by their employers during the days of attending congresses, meetings, conferences, seminars, training and coaching conducted by the superior union and are not included in the time specified in Clause 2 of this Article; travel, food, accommodation and living expenses during the days of attendance are paid by the union.
Non-professional union officials who are paid by employers are entitled to union responsibility allowances according to the regulations of the Vietnam General Confederation of Labor.
Meanwhile, the 2012 Trade Union Law (currently in effect) ensures the conditions for trade union activities as stipulated in Article 24. Accordingly, Article 24 stipulates that non-professional union officials are allowed to work 24 hours a month for the Chairman and Vice Chairman of grassroots unions; 12 hours a month for members of the Executive Committee, Heads and Deputy Heads of the Trade Union to work for the trade union and are paid by the employer. Depending on the scale of the agency, organization, or enterprise, the Executive Committee of the grassroots trade union and the employer will agree on the additional time.
In addition, non-professional union officials are entitled to take a day off from work and receive salary paid by the employer during the days of attending meetings and training called by the superior union; travel, accommodation and living expenses during the days attending the meeting and training paid by the union.
Part-time union officials are paid by employers and are entitled to union responsibility allowances according to the regulations of the Vietnam General Confederation of Labor.
Article 24 of the 2012 Trade Union Law also stipulates that full-time trade union officials are paid by the Trade Union, and are guaranteed by the employer's rights and welfare for the collective like employees working in agencies, organizations, and enterprises.
According to the definition in the Trade Union Law 2012, non-professional trade union officials are those who work concurrently elected by the Trade Union Congress and Trade Union Conference at all levels or appointed by the Trade Union Executive Committee or higher.
