On September 8, the People's Committee of Ba Ria - Vung Tau province announced that it had issued a decision regulating land division , land consolidation and the minimum area allowed for land division for each type of land in the area.
This Decision will replace Decision No. 44/2023 currently in effect.
According to the content of the decision, the division and consolidation of land plots must ensure the principles and conditions prescribed in Clauses 1, 2, 3, Article 200 of the 2024 Land Law.
In addition, for households and individuals, land division must ensure the following conditions: Ensuring rights to adjacent land plots according to Article 29 of the 2024 Land Law; the area after division must be equal to or larger than the minimum area specified in Clauses 1 and 2, Article 4 of the 2024 Land Law; land division must be carried out according to the planning specified in Article 66 of the 2024 Land Law, and the approved 1/500 detailed planning.
In case there is no 1/500 planning, apply the 1/2,000 planning or the existing approved construction planning.
For agricultural land planned for agricultural use, construction planning does not apply.
The Decision also clearly states that the minimum land area after subdivision for residential land is 80m2 , with a side not less than 5m (in Con Dao it is 60m2 ) and in contact with or having a path connecting to a traffic road managed by the State.
The minimum area for commercial service land and non-agricultural production land is 100m2 ; agricultural land is 1,000m2 ( in Con Dao it is 500m2 ) ....
This Decision does not apply to cases of selling old houses owned by the State; dividing land plots due to the State reclaiming part of the land plot; donating land to the State, to households and individuals to build charity houses, solidarity houses, agency headquarters, public works, etc.
This Decision takes effect from September 16, 2024. Previous transactions under Decision No. 44/2023/QD-UBND that have been received in accordance with regulations, or notarized, authenticated; recognized by law... before September 16 will continue to be implemented.
