According to the report, My Son Company Limited committed an administrative violation of occupying non-agricultural land in a rural area managed by the People's Committee of Tam Hung Commune with an area of 7,775.5 square meters. The company built illegal structures including: a concrete mixing line, an outdoor silo system production workshop, a guard house, a worker's house, a warehouse, an operator's house, and a garage.
On December 18, 2023, the City People's Committee issued Decision No. 4365/QD-XPHC on administrative sanctions against My Son Company Limited. On August 30, 2024, the City People's Committee issued Decision No. 3154/QD-UBND/QD-CCXP on enforcement of the decision on administrative sanctions against My Son Company Limited. Accordingly, money is forcibly deducted from the account to ensure enforcement of Decision No. 4365/QD-XPHC dated December 18, 2023 of the Chairman of the City People's Committee. The amount deducted is 300 million VND. At the same time, the original condition of the land plot before the violation is restored and the encroached land is returned for the violation; the illegal profit earned from the violation is 130,115,217 VND is required.
In the process of urging the implementation of the City People's Committee's Decisions, the District People's Committee has repeatedly organized dialogues, mobilized and requested My Son Company Limited to comply with the Decisions on administrative sanctions and restore the original state of the land plot before the violation, return the encroached land... However, up to now, the Company has not complied.
The conference also heard the plan to enforce the remediation of consequences for Mr. Ho Huu Khai and Mr. Nguyen Van Nghia, Hoang Dong commune. Accordingly, these two households use alluvial land outside the dike in Hoang Dong commune. This is an act of occupying agricultural land that is not rice-growing land, special-use forest land, protective forest land, production forest land in rural areas with an area of 0.5 ha to less than 1 ha (occupying agricultural land in Cong Tay field, village 5, Hoang Dong commune with an area of 9,862 m², on the land there are 2 houses and auxiliary works).
Thuy Nguyen District has issued decisions on administrative sanctions, applied remedial measures and decided to apply coercive measures to enforce the decision on applying remedial measures. The District People's Committee has organized direct dialogues with households to mobilize, persuade and explain legal policies in land management. However, to date, households have not complied.
Concluding the working session, Mr. Nguyen Huy Hoang, Deputy Secretary of the District Party Committee, Chairman of the People's Committee of Thuy Nguyen District assigned relevant agencies to continue reviewing the process, completing legal documents related to enforcement work; continue to propagate, mobilize, and persuade businesses and households to voluntarily dismantle illegal constructions and relocate assets.
The time to enforce administrative violations against My Son Company Limited is expected to be October 8, and the time to enforce remedial measures against Mr. Ho Huu Khai and Mr. Nguyen Van Nghia is expected to be October 10. The enforcement will be conducted publicly, democratically, objectively, ensuring order, safety, and compliance with the law.
