Lao Cai Provincial People's Committee has just issued Decision No. 27/2026/QD-UBND, detailing a number of contents on market development and management in the area.
The regulation focuses on key contents such as market model regulations, business point management, management decentralization, elimination of spontaneous business points and processes for transforming management, business, and market exploitation models. At the same time, the document clarifies the responsibilities of agencies, units, and localities in state management of markets, according to the Lao Cai information portal.
According to the decentralization, the commune-level People's Committee is fully responsible for managing markets in the area, from investment in construction, business operation organization to management and exploitation of infrastructure assets. The commune level also promulgates market regulations, approves plans for arranging and arranging business points, builds service prices for using sales area and organizes inspection and handling of violations. '
The regulation clearly states that the rental and use of business locations must be through a contract between small traders and the market management unit, ensuring publicity and transparency. For newly built or renovated and upgraded markets, the arrangement of business locations prioritizes old business households; the remaining locations will be drawn if the number is exceeded.
Notably, the regulation introduces a 7-step process to transform the market management model, from establishing the Transition Board, developing plans and options, and seeking opinions from relevant parties on the selection of management and exploitation units. The transformation must ensure publicity and transparency, not causing loss of state assets and maintaining social security stability.
In addition, the commune-level People's Committee is responsible for developing a plan to eliminate spontaneous business points; strengthen inspection and supervision, prevent recurrence, contributing to restoring business order and ensuring urban aesthetics.
The decision also promulgates market model regulations, specific regulations on operating hours, rights and obligations of small traders, goods standards, requirements on security and order, fire prevention and fighting, environmental sanitation and commercial civilization.
The decision takes effect from May 5, 2026, replacing previous regulations on market development and management in Lao Cai province.
