Ho Chi Minh City Social Insurance has just sent a notice to employers, health insurance participants management units, and educational and training institutions to guide units in implementing collection records - books, cards, and policies when merging and consolidating.
Regulations on procedures for collection - books, cards, money transfers
According to Ho Chi Minh City Social Insurance, during the time when departments, branches and sectors synchronously implement plans to reorganize and streamline the organization and apparatus to ensure the rights of social insurance, health insurance, unemployment insurance (UI), accident insurance, labor insurance, occupational diseases (BHTNLD-BNN), Ho Chi Minh City Social Insurance guides employers; units, organizations managing health insurance participants; educational and training institutions (collectively referred to as units) after having a decision on merging, consolidating, and terminating the implementation of procedures, records of collection - books, cards as follows:
For the procedures for collection - books, cards, transfer of money: For the merged/merged/dissolved unit (old unit), report a reduction in all employees (including employees on unpaid leave, sick leave, maternity leave, temporary postponement of labor contracts, detention...) participating in social insurance, health insurance, unemployment insurance, unemployment insurance - Internal income tax on all major unit codes and sub-codes (AD, BW, IC...) and transfer the full payment of social insurance, health insurance, unemployment insurance - Internal income tax.
For new/receiving units (new units): register newly/change unit information: fully declare form TK3-TS and note the old unit code; attach the original document on the merger/merger/end/end of operation/new establishment and report on increase in labor participating in social insurance, health insurance, unemployment insurance, unemployment insurance-BNN according to each main unit code and auxiliary code for managing subjects on unpaid leave, sick leave, maternity leave, temporary postponement of labor contracts, temporary detention (AD, BW, IC ...). In case the unit code has not been issued, contact the district/ county/inter-district social insurance agency where the receiving unit is located to get the code in time.
In case the old unit, after revoking the seal, no longer has legal status but has not yet submitted a labor reduction report, the new unit will report an increase in labor together with a copy of the document on the merger/merger/dissolusion/re establishment of a new operation.
After increasing the number of employees at the new unit, the software of the Social Insurance sector automatically reduces the number of employees, reducing the value of health insurance card use at the old unit according to Official Dispatch No. 2745/BHXH-BT dated July 23, 2018 of Vietnam Social Insurance.
At the same time, transfer all social insurance, health insurance, unemployment insurance, unemployment insurance - Internal income tax of the old unit according to the correct structure (+ Social insurance+103+00+Code of old unit+Code of old social insurance agency+dong Social Insurance+) and submit the application for confirmation of the social insurance, unemployment insurance process, issue a book issuance form (Document receipt 620) via postal service to the social insurance agency managing the old unit.
Regulations on procedures and documents for resolving social insurance regimes
Ho Chi Minh City Social Insurance said that with procedures and documents for resolving social insurance regimes: Prepare documents for resolving social insurance regimes according to regulations (for units that have paid social insurance, health insurance, and unemployment insurance for employees until the month before the social insurance regimes arise) along with related documents arising before the merged/merged/ acquired/dissolved operations under the new unit code transferred to the social insurance agency according to the social insurance, health insurance, and unemployment insurance revenue decentralization to be resolved and social insurance benefits paid promptly and fully to employees.
The Social Insurance Agency will fully confirm the social insurance and unemployment insurance process of employees until the unit has paid the full amount.
In case of excess money, the remaining amount of the old unit code will be transferred to the first quarter of the new unit code or refunded according to the regulations of Vietnam Social Insurance. In case of late payment of social insurance, a letter will be sent inviting representatives of the new unit and the old unit to work at the social insurance agency to make a unified record of the number of employees, the amount of late payment including interest. Transfer the late payment amount of the old unit code to the amount to be collected at the beginning of the new unit code.
Ho Chi Minh City Social Insurance requires units and organizations to comply with the above instructions, review the list of employees under management, declare documents to increase/decrease/adjust the subject/level of payment and social insurance regime documents according to regulations. In case of delay, affecting the social insurance/health insurance benefits of participants, the unit will be fully responsible.
During the implementation process, if there are any problems, promptly respond to the Social Insurance agency for consideration and resolution.
