According to the indictment of the People's Procuracy of Region 10, defendant Pham Van Hung (born in 1986, residing in Bac An Phu Ward, Hai Phong City) is the person who must serve the sentence and has received the Decision to serve the sentence according to the request No. 03/QD-CCTHADS dated October 5, 2023 of the Civil Judgment Enforcement Department of the old Kinh Mon Town (now the Judgment Enforcement Department of Region 10 - Hai Phong) to enforce the First Instance Criminal Judgment No. 21/2021/HNGD-ST dated May 28, 2021 of the People's Court of Kinh Mon Town (now the People's Court of Region 10 - Hai Phong).
The content of the verdict forced Pham Van Hung to give his joint child P.H.A (born on August 13, 2020) to Ms. Nguyen Thi H for custody, care, foster care, and education. The time to raise children together is from May 2021 until the child is grown up (age 18 years old). However, Hung did not voluntarily serve his sentence.
During the implementation of the judgment, the enforcement agency applied enforcement measures and issued a Decision to administratively sanction Hung for the act of "Not serving the judgment" and repeatedly the Civil Judgment Enforcement Department of Kinh Mon town coordinated with local authorities to explain, mobilize, urge, and persuade, but Pham Van Hung still did not give the joint child to Ms. H for raising, caring for, and educating despite having conditions to serve the judgment.
On December 20, 2024, Kinh Mon Town Civil Judgment Enforcement Office issued a document recommending criminal proceedings and prosecution of Pham Van Hung for the crime of Not complying with the judgment as prescribed in Article 380 of the Penal Code.
The trial panel sentenced Pham Van Hung to 7 months in prison for the crime of Not complying with the sentence prescribed in Clause 1, Article 380 of the Penal Code.
