Ministry of Agriculture and Environment responds to proposals on compensation when land is recovered

The Ministry of Agriculture and Environment said it is continuing to improve policies to effectively implement the 2024 Land Law.

The Ministry of Agriculture and Environment received a petition from voters in Ninh Binh province with the content: Soon issue unified and specific guidelines in the implementation of the new Land Law, especially regulations on compensation, support, resettlement, and land price determination, to ensure the legitimate rights of the people.

Regarding this proposal, the Ministry of Agriculture and Environment reports as follows: To implement the 2024 Land Law, the Government has issued Decree No. 88/2024/ND-CP dated July 15, 2024 stipulating compensation, support, and resettlement when the State recovers land and Decree No. 71/2024/ND-CP dated June 27, 2024 stipulating land prices; accordingly, there have been many new breakthrough and important contents contributing to the goal of perfecting institutions and policies on land recovery, compensation, support, and resettlement when the State recovers land and land prices.

Implementing the direction of the Politburo, the National Assembly, the Government and the Prime Minister on reorganizing the apparatus, building a 2-level local government model and promoting administrative procedure reform in the field of land, the Ministry of Agriculture and Environment has coordinated with ministries, branches, and localities to assess the process of organizing the implementation of the Law, proposing contents that need to be amended and supplemented to the Land Law to meet the requirements of the 2-level local government, and at the same time remove difficulties and obstacles to continue promoting land resources for national development in the new era, specifically:

On December 11, 2025, at the 10th Session, the Ministry of Agriculture and Environment advised the Government to submit to the National Assembly for approval Resolution No. 254/2025/QH15 stipulating a number of mechanisms and policies to remove difficulties and obstacles in organizing the implementation of the Land Law, effective from January 1, 2026.

The Ministry of Agriculture and Environment has submitted to the Government for promulgation the following Decrees: No. 151/2025/ND-CP dated June 12, 2025, regulating the decentralization of authority of local authorities at 2 levels, delegation of power, and decentralization in the field of land; No. 226/2025/ND-CP dated August 15, 2025, amending and supplementing a number of articles of Decrees detailing the implementation of the Land Law; No. 49/2026/ND-CP dated January 31, 2026, detailing and guiding a number of articles of Resolution No. 254/2025/QH15 of the National Assembly stipulating a number of mechanisms and policies to remove difficulties and obstacles in organizing the implementation of the Land Law, including amending, supplementing, and perfecting regulations on compensation, support, resettlement, and determining land prices.

The Ministry of Agriculture and Environment will continue to closely monitor the implementation of the 2024 Land Law, Resolution No. 254/2025/QH15 and guiding documents for implementation; summarize difficulties and obstacles from ministries, branches, and localities to promptly guide, report and advise competent authorities for consideration and resolution.
