The Ministry of Agriculture and Environment received a petition from voters in Nghe An province with the content: Voters reflect that there is still overlap and inadequacy between the Land Law and the Forestry Law in the management and use of forestry land. According to the Forestry Law, the State allocates production forests without collecting money to households, individuals, and communities legally residing in the locality, and the allocation of forests must be consistent and synchronized with land allocation; however, Article 184 of the 2024 Land Law stipulates that households and individuals are not allowed to allocate production forest land that is natural forest, causing contradictions and obstacles in practical implementation.
Therefore, voters proposed that the Ministry of Agriculture and Environment advise the Government to submit to the National Assembly for studying the amendment and adjustment of Article 184 of the Land Law in the direction of allowing the allocation of production forests that are natural forests to households and individuals for management, protection, and use, especially for ethnic minorities, in order to create conditions for people to access state policies, improve the efficiency of forest management, protection and development.
Regarding this proposal, the Ministry of Agriculture and Environment reports as follows: The Ministry of Agriculture and Environment acknowledges the proposal of voters in Nghe An province to advise and submit to competent authorities for consideration and completion of regulations on allocating production forest land that is natural forest when assessing comprehensive amendments and supplements to the Land Law to ensure unity and synchronization between the Forestry Law and the Land Law.
