How to verify land origin when applying for a red book for the first time

When applying for a red book for the first time, people need to prepare documents to verify the origin of the land. The Ministry of Agriculture and Environment has guided relevant regulations.

The provision of information and land data is carried out in accordance with the provisions of the Law on Access to Information and Circular No. 56/2024/TT-BTC stipulating the collection level, collection regime, payment, management, and use of fees for exploitation and use of land documents from the National Information System on Land.

According to the Government Electronic Information Portal, a citizen in Hanoi submitted a dossier to apply for a Certificate of Land Use Rights for the first time for a land plot with an area of 35m2. However, the ward's land administration official returned the dossier and requested supplementary documents proving that the land plot had been used as stable residential land from before December 1993 to serve as a basis for determining tax obligations.

This citizen's land plot was divided by his biological mother (now deceased) to his children, including this citizen from 2003. In 2010, this citizen separated it to build a level 4 house and paid separate land tax, with full non-agricultural land tax receipts, electricity and water contracts in his name.

The origin of the land plot is residential land of the family, registered in the name of the biological mother and used stably from before December 15, 1993, with a receipt for house and land tax payment in 1993.

The ward's land administration official requested to supplement documents to verify stable residential land but did not specifically answer what kind of documents were needed for verification.

This citizen went to the Public Administrative Service Center to request extracts from the inventory book and cadastral book to check land plot information and verify the origin of the land plot.

However, officials of the Public Administrative Service Center said that from May 21, 2026, there is no longer the nghiệp vụ of providing inventory books due to Resolution No. 66.19/2026/NQ-CP on abolishing this nghiệp vụ and requested citizens to contact the Ward Land Administration Department to apply for inventory books.

After that, this citizen met with the ward land administration official to apply for a land use right certificate, but was told that the ward currently does not have a land use right certificate because the old ward has not handed it over.

Citizens ask in cases like their own family, which agency or unit should they request to extract the cadastral inventory book.

The Ministry of Agriculture and Environment has responded to the reflection on requesting extracts from land registers to verify the origin of land.

According to the provisions of Appendix VI (attached to Resolution No. 66.19/2026/NQ-CP dated May 18, 2026 of the Government) on reducing, decentralizing, simplifying administrative procedures and reducing, simplifying business conditions under the management scope of the Ministry of Agriculture and Environment, the provision of information and land data is carried out in accordance with the provisions of the Law on Access to Information and Circular No. 56/2024/TT-BTC stipulating the collection level, collection regime, payment, management, and use of land exploitation and use fees from the National Information System on Land.

The Ministry of Agriculture and Environment responds so that citizens can know, study, and contact competent authorities in the locality to be implemented according to the provisions of law.
