A resident in Ho Chi Minh City said that the family's land plot originated from the church assigning it to parishioners for use from 1965. The land plot then went through many owners and was bought back by this person in 1997.
After receiving the transfer, people build houses, use land stably, have registration and declaration and are certified by the Ward People's Committee for the status of houses and land. This person also continued to carry out registration and declaration in 1999, 2005 and 2014.
Currently, people carry out procedures to register land and assets attached to land to request the first-time Certificate of Land Use Rights according to regulations.
However, when studying the dossier components in Appendix I issued with Decree No. 151/2025/ND-CP, people found that there are up to 16 different types of documents. Among them are documents such as decisions on administrative violations in the field of land, and fines payment documents.

According to people, these documents are not suitable for their case because there are no administrative violations. In addition, some other types of documents such as inheritance records, transfer of land use rights or documents establishing rights for adjacent land plots also do not arise in this case.
From the above reality, people request functional agencies to clearly guide whether the first-time issuance of a red book requires the submission of all documents in the dossier or is only applied to specific cases. At the same time, if the land user does not have violations or does not have legal relations such as inheritance or transfer, is it necessary to submit the corresponding documents or not.
Answering this content, the Ministry of Agriculture and Environment said that this is a specific case under the jurisdiction of the locality. The review needs to be based on archived records and specific regulations issued by the locality according to its authority to enforce the Land Law and related legal regulations. Therefore, the Ministry does not have a basis to answer directly for specific cases.
However, the Ministry of Agriculture and Environment stated the principle that the components of dossiers submitted in the procedure for issuing a Certificate of Land Use Rights for the first time are applied in each case corresponding to each origin of land use.
This means that people do not necessarily have to submit all kinds of documents if those documents are not related to their case.
The Ministry of Agriculture and Environment also said that Decree No. 49/2026/ND-CP has abolished and assigned authority to provincial-level People's Committees to specifically regulate the composition of dossiers submitted, order, and administrative procedures on land, including procedures for issuing initial Certificates.
Therefore, people need to contact competent authorities in the locality for guidance and specific answers before submitting dossiers to the commune-level People's Committee.
According to the content of the Ministry of Agriculture and Environment's response, the preparation of dossiers for the first red book is to be based on the origin of land, land use process, current status of dossiers and local regulations, instead of rigidly applying all documents in the list.
