On July 21, the Ministry of Justice just publicly announced the appraisal documents on the draft Law on Real Estate Business (amended).
In which, the Ministry of Construction - the drafting agency - has a Report on Receiving and Explaining the content of the draft Law on Real Estate Business (amended) according to the Resolution of the specialized law-making session in July 2026.
The Ministry of Construction said that it has reviewed and completed relevant regulations on requirements and conditions for real estate business, in which in the chapter on State management of real estate business, it completes regulations on sanctions to control and prevent speculation and market manipulation.
Accordingly, measures to regulate the market, state management of real estate business, and state management responsibilities for real estate business are stipulated in Articles 57, 59 and 60 of the draft Law.
In addition, in the draft Law, there are regulations that entities related to real estate business activities update data on legal information of eligible real estate for business, and publicize sample contracts on the Housing and Real Estate Market Information System before application.
Regarding the content of the one-stop mechanism, one focal point, and a standard process in resolving administrative procedures for investment, project transfer, and real estate transactions, the Ministry of Construction explains as follows:
Currently, the content of regulations on real estate business has been decentralized with the authority to thoroughly resolve to provincial-level People's Committees and provide online public services on the National Public Service Portal. Procedures have been fully standardized in terms of implementation order, dossier components, number of dossiers, forms, declarations and settlement deadlines, ensuring uniformity in organization and implementation nationwide; at the same time, through review, the draft Law on Real Estate Business (amended) continues to cut and streamline procedures, contributing to creating favorable conditions for people and businesses to conveniently implement in practice.
