The project has "changed its name and ownership" many times
The An Binh Tan Urban Area Project was originally named the Western Residential Area of Song Tac I Residential Area, approved by Khanh Hoa province in 2004, with an area of 59.84 hectares.
The investor at that time was the Technical Supplies Construction and Installation Company under the Ministry of Agriculture and Rural Development.
In 2010, Khanh Hoa province lifted the decision approving the old project. It was not until 2012 that the An Binh Tan Urban Area Project was allowed to be implemented in the form of a new urban area, with an expansion scale of 71.69 hectares.
The goal of the project is to build a synchronous urban area with technical infrastructure, landscape architecture, population of 14,300 people, total investment capital of nearly 998 billion VND.
According to the plan, the project must complete all technical infrastructure and component works before April 30, 2027.
However, by 2025, after more than a decade of implementation, the project has not yet completed compensation and site clearance.
The total land area allocated through 4 phases is only 64.79ha/71.69ha, with about 6.9ha remaining unallocated.
Land allocation, investor selection in violation of regulations
According to the inspection conclusion, the Department of Construction of Khanh Hoa province advised the Provincial People's Committee to select an investor according to the designation form, but did not fully carry out the procedures to submit a request for the investor to prepare a proposal according to the provisions of Circular 04 2006 of the Ministry of Construction.
Notably, land allocation without an investment permission decision is not in accordance with the provisions of Decree 02 2006 of the Government on the regulations of new urban areas.
The Department of Natural Resources and Environment of Khanh Hoa has hired a real estate property consulting service joint venture to determine land prices, but since 2018, it has not yet issued certificates and land price plans.
Also according to the conclusion, the Technical Materials Construction and Installation Joint Stock Company issued Decision No. 71/QD-XL dated July 9, 2012 approving the construction drawing design and the total project estimate, while the environmental impact assessment report and fire prevention and fighting design approval have not been approved, violating the provisions of Article 18 of Decree 12/2009/ND-CP.
The Provincial Inspectorate requested the Khanh Hoa Provincial People's Committee to direct relevant departments, branches and Nam Nha Trang ward (areas with somewhat stuck areas) to urgently and thoroughly handle the problems and problems in compensation, recovery and land allocation.
At the same time, fully implement legal procedures so that the project can be implemented in accordance with regulations.
