The Government has just issued Decree No. 207/2026/ND-CP dated June 15, 2026, detailing a number of articles of the Construction Law on quality management, construction and maintenance of construction works. The Decree takes effect from July 1, 2026.
Individual houses from 7 floors or more must be designed by organizations and individuals with expertise according to design regulations.
a) For individual housing projects that simultaneously have the following criteria: under 3 floors, without a basement, with a total floor area of less than 250 m2, and a height of less than 12 m, the homeowner is allowed to self-organize the construction design of the project.
b) For individual houses under 7 floors or with 1 basement, except for the cases specified in point a above, the design must be carried out by organizations and individuals with expertise and experience in accordance with the law.
c) For individual houses from 7 floors or more or with 2 or more basements, the design must be carried out by organizations and individuals with expertise and experience in accordance with the law; the design dossier must comply with the regulations of standards and technical regulations on fire prevention and fighting.
Managing the construction of individual housing projects
The Decree stipulates that homeowners are responsible for installing construction signs at the entrance to the construction site; the location and size of the signs must ensure easy observation and clearly display the name, contact address, phone number of the homeowner and the contents specified in points a, b, d, clause 1, Article 13 of this Decree.
Housing owners organize construction, supervise construction and are responsible for safety in construction, adjacent works and the environment during construction. Encourage housing owners to organize construction supervision, prepare and store records of individual housing projects according to the provisions of this Decree.
Housing owners must organize construction and supervise construction of works according to the provisions of this Decree for individual housing projects.
Content of supervision of construction of individual houses
The Decree stipulates the content of construction supervision of individual houses, including: Construction measures, safety measures for houses and adjacent and surrounding works; quality of materials, construction components, and equipment before putting them into construction.
Scaffolding system, temporary support structures and machinery and equipment serving construction; measures to ensure safety in construction.
In case the homeowner converts the function of using part or all of the individual housing project along with the repair and renovation of the project, the construction design and construction of the project must comply with the regulations of technical regulations, applicable standards and be consistent with the new function of the project.
In addition to the above regulations, the construction of individual houses, conversion of function of using part or all individual houses must comply with the provisions of law on fire prevention and fighting, environmental protection and other relevant laws.
