The 2024 Land Law stipulates that households and individuals who have been using land since before July 1, 2014 without documents on land use rights and have not violated land laws and are not in cases where land was allocated without proper authority will be granted a red book.
Also according to the 2024 Land Law, when applying for a red book for land without documents, people need to pay the following fees:
Firstly, the registration fee: Pursuant to Decree 10/2022/ND-CP and Circular 13/2022/TT-BTC, the registration fee payable for real estate when registering land use rights and house ownership rights remains the same as before, specifically the fee collection rate is 0.5%.
The registration fee payable is calculated by multiplying the registration fee calculation price (price of 1 square meter of land in the Land Price List) by 0.5%. In which, the registration fee calculation price for land is the land price in the Land Price List issued by the Provincial People's Committee at the time of registration fee declaration.
Second is the file appraisal fee: According to the provisions at Point i, Clause 1, Article 5 of Circular 85/2019/TT-BTC, amended at Point b, Clause 3, Article 1 of Circular 106/2021/TT-BTC, the file appraisal fee for granting a Certificate is a fee prescribed by the Provincial People's Council, so some provinces and centrally run cities will not have to pay a fee when granting a Certificate for the first time.
Based on the area scale of the land plot, the complexity of each type of dossier, the purpose of land use and specific local conditions to determine the fee level for each case.
Third is the certificate issuance fee: According to Clause 5, Article 3 of Circular 85/2019/TT-BTC, the certificate issuance fee is decided by the Provincial People's Council, so the collection rate in each province or city may be different.
Fourth is land use fee: Unlike land with papers, in many cases land without papers must pay land use fee.
Land use fee is the amount of money that land users must pay to the State when the State allocates land with land use fee collection, allows change of land use purpose, or recognizes land use rights. Depending on each land user, land use fee collection is regulated differently.
Land without documents is land without one of the types of documents on land use rights stipulated in Article 100 of the 2013 Land Law and Article 18 of Decree 43/2014/ND-CP. The law does not stipulate a specific amount because land use fees depend on the type of land, area, and location of each plot of land.
In addition, residents may be required to pay additional measurement fees.
