What is agricultural land?
According to Article 9 of the 2024 Land Law, based on the purpose of use, land is divided into 3 groups: Agricultural land group; Non-agricultural land group; Unused land group.
Accordingly, the agricultural land group includes the following types of land: Land for growing annual crops, including rice land and land for growing other annual crops; land for growing perennial crops; forestry land, including special-use forest land, protective forest land, production forest land; aquaculture land; concentrated livestock land; salt-making land; other agricultural land.
Can I build a house on agricultural land?
Clause 2, Article 178 of the 2024 Land Law stipulates:
Useres of agricultural land are allowed to convert crop and livestock structure to use land for multiple purposes as prescribed in Article 218 of this Law; are allowed to use an area of land as prescribed by the Provincial People's Committee to build works directly serving agricultural production.
In case of using rice-growing land, it shall comply with the provisions of Article 182 of this Law".
Thus, the information that the 2024 Land Law allows building houses on agricultural land is completely incorrect.
Agricultural land users who are allowed to convert crop and livestock structure for multi-purpose use must still ensure:
- Not changing the type of land according to the land classification prescribed in Clauses 2 and 3, Article 9 and determined in the types of documents prescribed in Article 10 of this Law.
- Not losing the necessary conditions to return to land use for the main purpose.
- Does not affect national defense and security.
- Limit the impact on the conservation of natural ecosystems, biodiversity, and environmental landscapes.
- Does not affect the land use of adjacent plots of land.
- Fully fulfill financial obligations according to regulations.
- Comply with relevant laws.
Regarding the regulation that agricultural land users are allowed to use an area of land according to the regulations of the Provincial People's Committee to build works directly serving agricultural production, they must still wait for the regulations of the Provincial People's Committee of each locality. At the same time, it is necessary to ensure compliance with relevant legal regulations.
