Accordingly, in Clause 11, Article 11 of Land Law No. 31/2024/QH15 stipulates that one of the prohibited acts in the land field includes "Prohibition of gender discrimination in land management and use". band".
It can be seen that gender equality has received more attention when there are regulations related to the rights and obligations of women as land users.
Currently, the situation of inequality and gender discrimination in land management and use still exists, including:
- When a girl gets married, she is not allowed to share the land
- Only leave the house and land to the son to worship and pass on
- Unequal inheritance division between sons and daughters...
Gender inequality is one of the prohibited things in Article 26 of the 2013 Constitution. According to Clause 3, Article 26 of the Law on Gender Equality No. 73/2006/QH11, gender discrimination is defined as the restriction, exclusion or does not recognize or value the roles and positions of men and women, causing gender inequality in all areas of social and family life.
Accordingly, male and female citizens must be equal in all aspects. The state must have policies to ensure people's gender equality rights and opportunities.
Up to now, other legal documents in the fields of civil affairs, marriage, inheritance... all more or less directly or indirectly mention regulations on gender equality in real life. However, until now the Land Law 2024 has specific regulations prohibiting gender discrimination in land management and use.
There is currently no guiding document stipulating fines and sanctions for regulations prohibiting gender discrimination in land management.
