Mr. V.V.K's grandfather had a red book issued by the District People's Committee (old) on March 3, 1996. In 2022, his grandfather passed away, and his grandmother wanted to exchange it for a new book to carry out procedures for land separation and donation, but his grandfather's name in the book was incorrect.
Mr. V brought the excerpt from his grandfather's death certificate, ID card (photocopy), tax documents, household registration book to the Commune People's Committee to request procedures to correct his name in the red book (recorrecting these 2 names as the same person), but the official did not accept the dossier.
Mr. V asked, what types of documents are required to submit documents proving errors in the information of the person granted the Certificate compared to the information at the time of requesting correction or errors in information about land plots and assets attached to land compared to the information on the issued Certificate?
The Ministry of Agriculture and Environment answers this question as follows:
The application of policies to consider and issue Certificates to households and individuals who are using land needs to be based on each specific case and needs to be based on land management records in the locality, therefore, the Ministry of Agriculture and Environment does not have a basis to answer specifically. The Ministry of Agriculture and Environment has opinions on the principle as follows:
Clause 1, Article 152 of the 2024 Land Law stipulates cases of correction of Certificates with errors. Accordingly, one of those cases is "Having information errors of the person granted the Certificate compared to information at the time of correction".
In Section XIV, Content C, Part V of Appendix I issued together with Decree No. 151/2025/ND-CP, regulations on the order and procedures for correcting the issued Certificate have been stipulated. Accordingly, point c, point 2 of this Section stipulates "Documents proving information errors of the person granted the Certificate compared to information at the time of requesting correction or information errors about land plots, assets attached to land compared to information on the issued Certificate" are understood as personal documents such as Identity Card or Citizen Identification Card, Birth Certificate or other documents that show information about the person granted the Certificate.
According to the presented content, currently the person granted the Certificate has died, so the person with related rights and obligations needs to carry out procedures for inheritance of land use rights according to the provisions of civil law to specifically identify the person with land use rights, as a basis for issuing a Certificate to the person with rights according to the provisions of law.
