Procedures for canceling land use registration and subleasing are applied according to Decision 2304/QD-BNNMT, effective from July 1, 2025.

Pursuant to the Appendix issued with Decision 2304/QD-BNNMT in 2025, the procedures for canceling land use registration and subleasing land use rights in infrastructure construction and business projects are as follows:

(1) Implementation procedures:

Step 1: Applicants submit their application to one of the following locations in the province:

- In case of domestic organizations, religious organizations, affiliated religious organizations, foreign organizations with diplomatic functions, economic organizations with foreign investment capital, foreign organizations, and foreign individuals, the dossier must be submitted to the Public Administration Service Center or the Land Registration Office.

- In case individuals, communities, or people of Vietnamese origin residing abroad submit the dossier to the Public Administration Service Center or the Land Registration Office or Branch of the Land Registration Office.

When submitting the application, the registered candidate can choose to submit a copy of the document and present the original to the officer receiving the application for comparison inspection or submit the original of the document or submit a certified or certified copy of the document; in case of submitting the application online, the submitted document must be digitized from the original or a certified and certified copy of the document.

In case of confirming the change on the issued Certificate, the original Certificate must be submitted.

In case of submitting a copy or digital copy of all documents, when receiving the results of handling administrative procedures, the registered candidate must submit the original documents in the dossier components according to regulations.

Step 2: The dossier receiving agency implements:

- Check the completeness of the dossier components; issue a dossier receipt and schedule a return of results.

In case the documents are not complete, the documents must be returned with the Supplement and Complete Application Form so that the applicant can register to complete and supplement according to regulations.

- In case the Public Administration Service Center receives the dossier, the dossier shall be transferred to the Land Registration Office or Branch of the Land Registration Office.

Step 3: The Land Registration Office, Branch of the Land Registration Office shall:

- Confirm the removal of lease or sublease on the issued Certificate of the project investor and return the Certificate to the project investor.

- Revoking the issued Certificate from the lessee or the lessee.

- Adjust and update changes in cadastral records and land databases.

(2) How to do:

- Submit directly to the Public Administration Service Center or the Land Registration Office or Branch of the Land Registration Office.

- Pay via postal service.

- Submit online on the Public Service Portal.

- Submit at the location agreed upon between the registration ungender and the Land Registration Office, Branch of the Land Registration Office.

(3) Document composition:

- Application for registration of changes in land and assets attached to land according to Form No. 18 issued with Decree 151/2025/ND-CP.

- Documents on the cancellation of lease, cancellation of sublease of land use rights.

- Documents on representation according to the provisions of civil law in cases of procedures performed through representation.

(4) Processing time: No more than 3 working days.

For mountainous communes, islands, remote areas, areas with difficult socio-economic conditions, and areas with especially difficult socio-economic conditions, the implementation time will be increased by 13 working days.
