According to the Appendix issued with Decision 2304/QD-BNNMT in 2025, the procedures for granting land use rights to the State when the land plot has not been granted a red book are as follows:
(1) Procedures for implementing procedures for donating land use rights to the State when the land plot has not been granted a red book
Step 1: The land user submits the dossier to the Public Administration Service Center or the People's Committee at the commune level.
In case there is a meeting minutes between the People's Committee at the commune level and the land user regarding the donation of land use rights, the land user does not have to submit the dossier.
Step 2: The competent land management agency at the commune level organizes the implementation:
- Measuring and adjusting cadastral maps or extracting cadastral maps of land plots.
- Transfer the file to the Land Registration Office or Branch of the Land Registration Office for editing and updating to the cadastral records.
Step 3: The land user, the owner of the property attached to the land shall carry out the procedures for registering land and assets attached to the land, and issue a Certificate for the first time according to regulations for the remaining area of the land plot (if any).
(2) How to carry out procedures for donating land use rights to the State when the land plot has not been granted a red book
- Submit directly to the People's Committee at the commune level.
- Pay via postal service.
- Submit online on the Public Service Portal.
(3) Components and quantity of dossiers for donating land use rights to the State when the land plot has not been granted a red book
- Document composition: Document on donation of land use rights or meeting minutes between representatives of villages, hamlets, villages, hamlets, hamlets, bombs, villages, hamlets, residential groups, and residential areas with land users on donation of land use rights.
- Number of documents: 1 set.
(4) Deadline for handling procedures for donating land use rights to the State when the land plot has not been granted a red book
The processing time for cases of land use rights donation is no more than 10 working days.
For mountainous communes, islands, remote areas, areas with difficult socio-economic conditions, areas with especially difficult socio-economic conditions, the implementation period shall not exceed 20 working days.
