Ho Chi Minh City - Submitted land plot separation dossiers before January 1, 2026, if not resolved, new land plot separation regulations will be applied.

Ho Chi Minh City People's Committee has just issued Decision No. 67/2026/QD-UBND regulating the conditions for land plot separation, conditions for land plot consolidation and minimum area for land plot separation in Ho Chi Minh City.

Accordingly, residential land with a minimum area is resolved to be divided into 5 areas with corresponding areas.

Area 1 of the minimum residential land area to be split is 36m2, the width and depth of the land plot is no less than 3m, including wards: Saigon, Tan Dinh, Ben Thanh, Cau Ong Lanh, Ban Co, Xuan Hoa, Nhieu Loc, Xom Chieu, Khanh Hoi, Vinh Hoi, Cho Quan, An Dong, Cho Lon, Binh Tay, Binh Tien, Binh Phu, Phu Lam, Chanh Hung, Phu Dinh, Dien Hong, Vuon Lai, Hoa Hung, Minh Phung, Binh Thoi, Hoa Binh, Phu Tho, Gia Dinh, Binh Thanh, Binh Loi Trung, Thanh My Tay, Binh Quoi, Hanh Thong, An Nhon, Go Vap, An Hoi Dong, Thong Tay Hoi, An Hoi Tay, Duc Nhuan, Cau Kieu, Phu Nhuan, Tan Son Hoa, Tan Son Nhat, Tan Hoa, Bay Hien, Tan Binh, Tan Son, Tay Thanh, Tan Son Nhi, Phu Tho Hoa, Tan Phu, Phu Thanh.

Area 2 of the minimum residential land area to be split is 50m2, the width and depth of the land plot is no less than 4m, including wards: Tan Thuan, Phu Thuan, Tan My, Tan Hung, Binh Dong, Dong Hung Thuan, Trung My Tay, Tan Thoi Hiep, Thoi An, An Phu Dong, An Lac, Binh Tan, Tan Tao, Binh Tri Dong, Binh Hung Hoa, Hiep Binh, Thu Duc, Tam Binh, Linh Xuan, Tang Nhon Phu, Long Binh, Long Phuoc, Long Truong, Cat Lai, Binh Trung, Phuoc Long, An Khanh.

Area 3 of the minimum residential land area to be split is 60m2, the width and depth of the land plot is no less than 4m, including wards: Dong Hoa, Di An, Tan Dong Hiep, An Phu, Binh Hoa, Lai Thieu, Thuan An, Thuan Giao, Thu Dau Mot, Phu Loi, Chanh Hiep, Binh Duong, Hoa Loi, Phu An, Tay Nam, Long Nguyen, Ben Cat, Chanh Phu Hoa, Vinh Tan, Binh Co, Tan Uyen, Tan Hiep, Tan Khanh, Thoi Hoa, Vung Tau, Tam Thang, Rach Dua, Phuoc Thang, Long Huong, Ba Ria, Tam Long, Tan Hai, Tan Phuoc, Phu My, Tan Thanh, Con Dao special zone.

The area of 4 minimum residential land plots to be split is 80m2, the width and depth of the land plot is no less than 5m, including communes: Vinh Loc, Tan Vinh Loc, Binh Loi, Tan Nhut, Binh Chanh, Hung Long, Binh Hung, Binh Khanh, An Thoi Dong, Can Gio, Thanh An, Cu Chi, Tan An Hoi, Thai My, An Nhon Tay, Nhuan Duc, Phu Hoa Dong, Binh My, Dong Thanh, Hoc Mon, Xuan Thoi Son, Ba Diem, Nha Be, Hiep Phuoc, Chau Pha, Long Hai, Long Dien, Phuoc Hai, Dat Do, Nghia Thanh, Ngai Giao, Kim Long, Chau Duc, Binh Gia, Xuan Son, Ho Tram, Xuyen Moc, Hoa Hoi, Bau Lam, Hoa Hiep, Binh Chau, Long Son.

The area of 5 minimum residential land plots to be split is 100m2, the width and depth of the land plot is no less than 5m, including communes: Thuong Tan, Bac Tan Uyen, Phu Giao, Phuoc Hoa, Phuoc Thanh, An Long, Tru Van Tho, Bau Bang, Long Hoa, Thanh An, Dau Tieng, Minh Thanh.

For agricultural land plots, the minimum area to be split is 500m2 for annual crop land, other agricultural land and 1,000m2 for perennial crop land, aquaculture land, salt production land, and concentrated livestock land.

The separation and consolidation of land plots must ensure the principles and conditions according to the provisions of the Land Law.

Regarding the conditions to ensure a walkway according to Point d, Clause 1, Article 220 of the Land Law and Clause 3, Article 11 of Resolution No. 254/2025/QH15, the People's Committees of wards, communes and the Con Dao special zone shall, based on the actual situation in the locality, consider and confirm walkways to ensure synchronous connection with the technical infrastructure of the area, requirements for escape, fire prevention and fighting and related conditions according to the provisions of law.

The land area identified as a common use walkway for two or more land plots is shown in the form of common use on the certificate of land use rights, ownership of assets attached to land.

Land plot separation dossiers should be submitted before January 1, 2026, and new land plot separation regulations should be applied if not resolved.

The decision on land plot separation of the People's Committee stipulates that cases that have submitted sufficient valid dossiers to carry out procedures for land plot separation and land plot consolidation before Resolution No. 254/2025/QH15 dated December 11, 2025 of the National Assembly takes effect (January 1, 2026) but have not been resolved, shall be implemented according to the provisions of this decision.

The Department of Agriculture and Rural Development is responsible for presiding over and coordinating with the Department of Justice to review the principles of application to dossiers received before the time the law changes, ensuring that it does not harm those who have submitted valid dossiers.
