Controversy over the transfer of management rights

From October 2025, the Management Board (MB) of Opal Boulevard apartment complex term 2022-2025 has expired its term of operation according to regulations.The apartment building meeting to elect the new term MB was held in April 2025 but was unsuccessful (due to the number of residents attending not reaching 50% according to regulations).Di An Ward People's Committee then decided to organize an extraordinary apartment building meeting on January 25, 2026 and then issued Decision No. 375/QD-UBND dated February 6, 2026 on recognizing the new term MB 2026-2029.
However, to date, the story of handing over apartment building documents between the new and old MBs has not been completed due to endless controversies.Talking to a reporter of Lao Dong Newspaper, Mr. Pham Duc Toan, head of the MB term 2022-2025, said that he had handed over the seal that had not yet been handed over because he believed that the MB term II showed signs of lack of transparency and dishonesty in the results of the extraordinary apartment building meeting on January 25, 2026 and there were many
For example, according to the developments at the working session on January 25, 2026, the minutes do not contain the content of approving the Regulations on organization and operation of the MB and financial revenue and expenditure of the Opal Boulevard apartment complex and the maintenance plan for 2026. However, the completed working minutes on January 25, 2026 (with the seal of Di An Ward People's Committee) have the above content. Therefore, Mr. Toan said that he is proposing to Di An Ward People's Committee to consider revoking or canceling the minutes.
According to the reply document from Di An Ward People's Committee, based on the opinions of residents present at the conference, it is proposed to approve the draft regulation on management, financial revenue and expenditure activities and maintenance in 2026. Considering that the maintenance plan for 2026 and the approved contents have basically not changed much compared to the old term regulations. Therefore, in order to soon stabilize the situation at the apartment building, representatives of Di An Ward People's Committee have authorized the new term MB to chair the conference to approve the draft regulation on management, financial revenue and expenditure activities and maintenance in 2026.
However, this answer is facing feedback from the Board of Directors of the old term with the reason that the approval of such an important regulation when the conference only has a few dozen residents cannot represent the total of 1,460 residents, the contents in the regulations of the Board of Directors of term II are also different from term I, which may cause serious consequences later.
To date, the dispute between the parties has not been resolved, and thousands of households are worried about their daily lives being affected.
Residents want to vote no confidence in the Board of Directors
Also in Di An ward, at Bcons Garden apartment building, there is also a tense dispute between thousands of residents and the MB that they elected. According to residents' reflections, the MB currently does not have enough personnel but still takes important steps related to management and operation. It is known that the MB was elected from the end of 2025 with 4 members, but by the beginning of April 2026, 2 people had resigned.

Residents proposed that Di An Ward People's Committee consider requesting the MB to organize an extraordinary apartment building conference.The reason given is that the management and operation contract has a clause on profit sharing from the common ownership area but has not been approved by residents' votes, which is not in accordance with regulations.
Residents also believe that the MB has not fully demonstrated management capacity, especially in receiving infrastructure when there is still a warranty period until 2027. Many opinions suggest that if the MB receives infrastructure handover from the Investor without careful inspection, it will easily lead to consequences. Residents may have to bear the responsibility of repairing technical errors, losing maintenance funds, disputes over common and private areas...
Faced with tensions between residents and the MB, on April 29, Di An Ward People's Committee, Ho Chi Minh City issued a document requesting to temporarily suspend the handover of apartment building records at Bcons Garden from the investor to the management board.
According to the Ward People's Committee, the decision was made after considering the petition of the collective of residents dated March 30, 2026, reflecting a number of issues related to the management board and requesting to temporarily suspend the handover of dossiers, and at the same time organize an extraordinary apartment building conference.
