On the morning of October 26, the National Assembly held a group discussion. Participating in the discussion, delegate Ma Thi Thuy (Tuyen Quang delegation) said that a content that has been discussed throughout recent sessions is related to the social insurance regime for individual business owners.
According to the delegate, this issue was directly questioned at the 5th session. At the 7th session, the delegate made a statement regarding the response to voters' petitions.
In the Resolution of the 7th session, the National Assembly assigned the Government to submit to the National Assembly Standing Committee a record of the compulsory social insurance payment period of business owners who participated before the effective date of the Law on Social Insurance to serve as a basis for resolving the social insurance regime in accordance with the provisions of the law on social insurance and Resolution No. 100/2023/QH15 dated June 24, 2023 of the National Assembly on questioning activities at the 5th session of the 15th National Assembly.
However, according to the delegate, up to now, the Government has not yet issued regulations to completely resolve this issue, causing frustration for voters and people related to the social insurance regime for business owners, those who have paid enough time to enjoy social insurance regime.
Citing information that in Tuyen Quang, nearly 300 business owners were affected by this content, the delegate suggested that the Government, based on the National Assembly Resolution, soon issue regulations so that these subjects can enjoy social insurance benefits as early as 2024.
According to statistics from Vietnam Social Security, as of May 31, 2023, there were 3,567 business household owners participating in compulsory social insurance; the amount paid to the Social Security Fund was about 113 billion VND.
9,648 business owners have had their sickness and maternity benefits resolved and paid, with the amount of 13.28 billion VND; 1 person has had their occupational accident and disease insurance benefits resolved and paid, with the amount of 21.55 million VND; 275 people have had their retirement and death benefits resolved, with the amount of 32.84 billion VND; 397 people have had their one-time social insurance benefits resolved, with the amount of 9.328 billion VND.
The Social Insurance Agency's collection of compulsory social insurance for business owners is not in accordance with the law.
According to current regulations, business owners are not subject to compulsory social insurance.
The Law on Social Insurance 2024 (effective from July 1, 2025) adds many groups of subjects to the list of subjects participating in compulsory social insurance, including business owners of business households with business registration participating according to Government regulations.
Accordingly, Point m, Clause 1, Article 2 stipulates that one of the subjects participating in compulsory social insurance from July 1, 2025 (when the law comes into effect) is the business owner of a business household that has registered to participate in accordance with Government regulations.
In the recently passed revised Law on Social Insurance, 5 groups are added to participate in compulsory social insurance, including business owners (with business registration).
