This draft Decree details the social pension benefits stipulated in the Law on Social Insurance No. 41/2024/QH15 issued by the 15th National Assembly on June 29, 2024, effective from July 1, 2025.
Conditions for receiving social pension benefits
The draft clearly states the subjects and conditions for receiving social pension benefits according to the provisions of Article 21 of the Law on Social Insurance as follows:
1- Vietnamese citizens are entitled to social pension benefits when they meet the following conditions:
a) 75 years of age or older;
b) Not receiving monthly pension or social insurance benefits, except in other cases as prescribed by the Government;
c) Have a written request to receive social pension benefits.
2- Vietnamese citizens from 70 to under 75 years old who belong to poor or near-poor households and meet the conditions specified in points b and c above are entitled to social pension benefits.
Social pension allowance 500,000 VND/month
The draft proposes that the subjects specified in Section 2 above shall receive a monthly social pension allowance of VND 500,000/month. In case this subject is also eligible for monthly social allowance, he/she shall receive a higher allowance.
Those who are receiving monthly social pension benefits when they die are entitled to funeral cost support at a level of 10,000,000 VND.
Time to receive social pension benefits
According to the draft, the time to receive social pension benefits for the subjects specified in Clause 1 above is as follows:
- Elderly people who are 75 years old before July 1, 2025 will receive benefits from July 1, 2025;
- Elderly people who are 75 years old after July 1, 2025 will receive benefits from the time they turn 75 years old.
The time to receive social pension benefits for the subjects specified in Clause 2 above is as follows:
- Elderly people who are 70 years old before July 1, 2025 will receive benefits from July 1, 2025;
- Elderly people who are 70 years old after July 1, 2025 will receive benefits from the time they turn 70 years old.
In case of requesting support for funeral expenses through public interconnected services, it shall be implemented according to the provisions of Articles 11, 12, 13, 14 and 15 of Decree No. 63/2024/ND-CP dated June 10, 2024 of the Government regulating the implementation of electronic interconnection of 02 groups of administrative procedures: birth registration, permanent residence registration, issuance of health insurance cards for children under 6 years old; death registration, deletion of permanent residence registration, settlement of funeral expenses and death benefits. In other cases, it shall be implemented according to the provisions of Clauses 3 and 4, Article 11 of Decree No. 20/2021/ND-CP.
The Decree detailing and guiding the implementation of a number of articles of the Law on Social Insurance on social retirement benefits is expected to take effect from July 1, 2025.
