Clause 6, Article 33 of Decree 33/2023/ND-CP stipulates as follows:
Part-time workers in villages and residential groups with no more than 3 positions (including Party Cell Secretary, Village or Residential Group Head, Front Work Head) are entitled to monthly allowances. In cases where the law provides otherwise, the provisions of that law shall apply.
Accordingly, the Head of the residential group is a non-professional position in the residential group.
Current Social Insurance Law stipulates: Part-time workers in communes, wards and towns are subjects participating in compulsory social insurance.
Thus, part-time workers in residential groups (including the Head of the Residential Group) are currently not subject to compulsory social insurance.
The Social Insurance Law 2024 (effective from July 1, 2025) has expanded the subjects participating in compulsory social insurance, in which, part-time workers in villages and residential groups are one of the subjects participating in compulsory social insurance.
Thus, from July 1, 2025, the Head of the residential group is a subject participating in compulsory social insurance.
