According to Clause 1.1, Section 5 of the Project attached to Decision 759/QD-TTg in 2025, the organization of local government at the provincial level (provinces and centrally run cities) is regulated as follows:
Organizational structure: Basically keep the same as the current model of local government organization at the provincial level as follows:
Provincial local governments include People's Councils (PCs) and People's Committees (PCs);
The provincial People's Council established 3 boards: Legal Department, Economic - Budget Committee, Culture and Social Committee (for the province with many ethnic minorities that may establish more ethnic minorities). The People's Council under the Central Government established 4 boards (Legal Department, Economic - Budget Department, Culture - Social Committee and Urban Committee) in accordance with the Law on Organization of Local Government 2025.
The organization of specialized agencies under the provincial People's Committee shall be implemented in accordance with Government regulations.
Enter the status quo agencies under the People's Council, specialized agencies and other administrative organizations under the People's Committee in the new provincial administrative unit formed after arrangement. For specific specialized agencies of the People's Council and the People's Committee of the provincial level, the organization of these agencies is decided by the provincial authorities in accordance with the provisions of the Law on Organization of the local government and the Government's guidance.
Provincial-level cadres, civil servants and public employees:
The number of cadres, civil servants and officials of the provincial level after the maximum arrangement does not exceed the total number of cadres, civil servants and public employees (the number of presence) of the provincial level before the arrangement and streamlining the payroll associated with the restructuring, improving the quality of the contingent of cadres, civil servants and officials, ensuring that within 5 years of basic layout as prescribed.
After the provincial local government, after arranging into operation, the Politburo is requested to hand over the Central Organizing Committee to coordinate with the Government Party Committee and relevant agencies based on the size of the population, the natural area, functions, tasks and powers of the provincial government to build and complete the job position submitted to the competent authority to assign payroll to localities.
Regime and policy:
Reserve the salary regime, policies and current position allowances (if any) of cadres, civil servants and public employees assigned to work at the new provincial-level administrative unit after the arrangement within 6 months. After this time, the salary regime, policies and position allowances will be implemented in accordance with the new provisions of law...
Accordingly, after 6 months from the date of being assigned to work at the new provincial administrative unit, civil servants and public employees will implement the salary regime, policies and position allowances in accordance with the new provisions of law.
