Pursuant to Sub-section 1, Section 8 of the Appendix to newly issued and abolished administrative procedures in the field of social insurance under the management of the Ministry of Home Affairs issued with Decision 863/QD-BNV in 2025, regulations on the procedures for enjoying maternity benefits for male workers when wives give birth are implemented as follows:
Step 1:
Employees are responsible for submitting the application to the employer. The deadline for submitting documents is no later than 45 days from the date of termination of maternity leave.
Step 2:
Within 7 working days from the date of receiving a complete dossier from the employee, the employer is responsible for making a list of employees on leave to enjoy maternity benefits with the dossier submitted to the social insurance agency.
Step 3:
The social insurance agency is responsible for handling the case within 7 working days from the date of receiving complete documents from the employer.
In case of not resolving the issue, a written response must be provided stating the reason.
