The Government has just issued Decree No. 211/2026/ND-CP stipulating penalties for administrative violations in livestock breeding.
Regarding violations of regulations on production, trading, and import of animal feed containing antibiotics, chemicals, biological products, and microorganisms banned from use in animal feed, the Decree stipulates:
1. A fine of between VND 5,000 and VND 10,000 shall be imposed for the act of producing, trading, and importing each animal feed product with an antibiotic content different from the content stated on the goods label or accompanying documents from 10% to less than 30%.
2. A fine of between VND 10,000,000 and VND 15,000,000 shall be imposed for one of the following violations:
a) Manufacturing, trading, and importing each animal feed product containing antibiotics for the purpose of treating diseases for livestock or veterinary drugs that are not prescribed to treat diseases for livestock without fully recording the information as prescribed;
b) Producing, trading, and importing each animal feed product with an antibiotic content different from the content prescribed or on the goods label or accompanying documents from 30% or more;
c) Producing each animal feed product containing antibiotics for the purpose of treating diseases for livestock without an application from a professional certificate holder or with an application but incomplete information according to the provisions of veterinary law.
3. A fine of between 15,000 VND and 20,000,00 VND shall be imposed for one of the following violations:
a) Producing, trading, and importing each animal feed product containing antibiotics for the purpose of preventing diseases for livestock;
b) Producing, trading, and importing each animal feed product containing antibiotics for the purpose of stimulating growth.
4. A fine of between VND 20,000,000 and VND 25,000,000 shall be imposed for the act of producing, trading, and importing each animal feed product containing veterinary drugs that are not allowed to circulate in Vietnam or have not been permitted by competent authorities to have a value of less than VND 200,000,000 or illegally profiting less than VND 100,000,000.
5. A fine of between 25,000,000 VND and 30,000,000 VND shall be imposed for the act of producing, trading, and importing each animal feed product containing veterinary drugs that are not allowed to circulate in Vietnam or have not been permitted by competent authorities to have a value of 200,000,000 VND or more or illegally profiting from 100,000,000 VND or more in cases where the competent authority conducting criminal proceedings has a decision not to prosecute a criminal case, a decision to cancel the decision to prosecute a criminal case, a decision to suspend investigation, a decision to suspend the case or a decision to suspend the case against the accused, exempting criminal liability according to the judgment.
6. The act of producing, trading, and importing animal feed containing chemicals, biological products, and microorganisms prohibited from being used in animal feed shall be penalized as follows:
a) A fine of between 60,000,000 VND and 80,000,000 VND shall be imposed for violations of producing, trading, and importing each animal feed product containing chemicals, biological products, and microorganisms prohibited from use in animal feed, if the total value of the violating animal feed product is less than 100,000,000 VND or illegal profit is less than 50,000,000 VND;
b) A fine of between 80,000,000 VND and 100,000,000 VND shall be imposed for the act of violating the production, purchase, sale, and import of each animal feed product containing chemicals, biological products, and microorganisms prohibited from use in animal feed, the total value of the violating animal feed products being 100,000,000 VND or more or illegally profiting from 50,000,000 VND or more when the competent authority conducting criminal proceedings has a decision not to prosecute a criminal case, a decision to cancel the decision to prosecute a criminal case, a decision to suspend investigation, a decision to suspend the case or a decision to suspend the case against the accused, exemption from criminal liability according to the judgment.
This Decree takes effect from August 5, 2026.
