On September 6, the Ministry of National Defense's electronic information portal reported that the Ministry of National Defense recently received a petition from voters of Ben Tre province sent by the People's Petition Committee under Official Dispatch No. 499/BDN dated June 14, 2024, with the following content: Point d, Clause 1, Article 20 of the 2019 Law on Militia and Self-Defense Forces stipulates: "Deputy Commander is a non-professional person at the commune level".
The regime of the Deputy Commander of the Commune-level Military Command is implemented according to Decree No. 33/2023/ND-CP dated June 10, 2023 of the Government regulating commune-level cadres, civil servants and non-professional workers at the commune level, in villages and residential groups.
However, the Deputy Commander of the Commune Military Command is a person who operates in the military field, local defense is a special activity, implementing the operating regime. At the same time, be ready to fight according to the provisions of Circular No. 43/2020/TT-BQP dated April 23, 2020 of the Minister of National Defense stipulating the combat readiness regime and the Militia and Self-Defense Force plan.
Therefore, the implementation of policies and regimes for Deputy Commanders of Commune-level Military Commands as non-professional workers is not appropriate.
Recommend that the Ministry of National Defense coordinate with the Ministry of Home Affairs to advise competent authorities to have regulations on separate regimes and policies for Deputy Commanders of Commune-level Military Commands to contribute to stabilizing and improving living conditions, and ensuring work peace of mind to successfully complete assigned tasks.
Regarding this content, the Ministry of National Defense said that Article 43 of the 2019 Law on Militia and Self-Defense Forces stipulates the responsibilities of ministries, agencies and organizations.
Accordingly, in Clause 2, Point c, the Ministry of Home Affairs shall preside over and coordinate with the Ministry of National Defense to direct and guide localities, relevant agencies and organizations on planning, training, fostering, and arranging the use of Commanders and Deputy Commanders of Commune-level Military Commands; on implementing regimes and policies for the command positions of Commune-level Military Commands.
In 2022, the Ministry of National Defense presided over and coordinated with the Ministries of Justice, Home Affairs, Finance, Planning and Investment, Labor - Invalids and Social Affairs, the Government Office and 63 provinces and cities nationwide to summarize and agree on proposals to amend and supplement a number of articles of Decree No. 72/2020/ND-CP dated June 30, 2020 of the Government detailing a number of articles of the Law on Militia and Self-Defense Forces on force building and regimes and policies for Militia and Self-Defense Forces.
On February 8, 2024, the Ministry of National Defense issued Report No. 523/BC-BQP explaining the acceptance of the direction of Deputy Prime Minister Tran Luu Quang on the draft amendment and supplement to a number of articles of Decree No. 72/2020/ND-CP in the direction of increasing the level of enjoyment of a number of regimes and policies of the militia and self-defense force.
In particular, there are adjustments to increase the level of position allowance and seniority allowance for Deputy Commanders of Commune-level Military Commands (at Point b, Clause 1; Clause 3, Article 1 of the draft Decree), to meet the requirements and military and defense tasks in the new situation.
