According to people's reflections sent to the Ministry of Finance, Clause 3, Article 82 of Decree 168/2025/ND-CP stipulates:
Households producing agriculture, forestry, fishery, salt making and street vendors, snack vendors, roaming traders, mobile businesses, seasonal businesses, providing services with low incomes are not required to register business households, except for doing business in industries and professions that require conditional investment and business. The People's Committees of provinces and centrally-run cities stipulate low income levels applied within the locality.
However, this regulation gives rise to different understandings.
First, households producing agriculture, forestry, fishery, salt making and street vendors, snack vendors, roaming traders, mobile businesses, seasonal businesses, providing services that these activities all require low income according to the Decision of the People's Committee will not need to register household businesses.
Second, only regulations on low-income services according to the Decision of the People's Committee and households producing agriculture, forestry, fishery, salt making, street vendors, snack vendors, roaming traders, mobile businesses, seasonal businesses (without distinguishing large/small scale, revenue level,...) are exempt from business household registration.
People hope that the Ministry of Finance will have specific guidelines on policies to have a basis for implementation in accordance with legal regulations.
Answering this question, the Ministry of Finance cited the provisions in Clause 3, Article 82 of Decree No. 168/2025/ND-CP dated June 30, 2025 of the Government on business registration, that households producing agriculture, forestry, fishery, salt making and street vendors, snack vendors, wholesalers, mobile businesses, seasonal businesses, providing services with low incomes are not required to register household businesses, except for businesses in industries and professions with conditional investment and business; People's Committees of provinces and centrally-run cities stipulate low income levels applied within the locality.
The Ministry of Finance affirms that, based on the above regulations, households engaged in agricultural, forestry, fishery production, salt making and street vendors, snack vendors, roaming traders, mobile businesses, seasonal businesses, and service providers with income meeting the regulations on low income levels prescribed by the People's Committees of provinces and centrally-run cities are not required to register household businesses.
Except for cases of doing business in conditional investment and business lines.
