On November 17, information from the Gia Lai Provincial Tax Department said that, implementing the conclusion (No. 263/KL-TTCP) of the Government Inspectorate, the unit has directed to overcome and correct shortcomings and violations according to requests and recommendations.
Accordingly, the land plot at 39 Han Mac Tu is public property, and the Gia Lai Provincial People's Committee has agreed to hand it over to an investor to build Hoang Dieu Asean High School. In which, Asean Community Education and Cultural Development Joint Stock Company is the investor.
For this land, the People's Committee of Gia Lai province during the period 2010 - 2016 did not rearrange public land and houses to organize auctions but sold assets on the land in a designated form.
In 2015 and 2016, Gia Lai Provincial Tax Department issued 2 Decisions No. 2729/QD-CT and Decision No. 1253/QD-CTGLA on land rent exemption for Asean Community Education and Cultural Development Joint Stock Company.
In 2024, realizing that the exemption of land rent for a land area of nearly 25,000 square meters was against regulations, the Gia Lai Provincial Tax Department issued a decision to cancel two previously issued documents.
A representative of the provincial Tax Department said: “After canceling the decision to exempt land rent, the unit will collect the correct and full amount that the enterprise must pay to the State budget. After working sessions and explanations, the enterprise agreed to pay back the money.”
The provincial Tax Department also reviewed capital transfer activities and individuals who declared and paid personal income tax at this project.
Because after leasing a public land area of nearly 25,000 square meters, the original investor transferred, bought and sold shares, and changed legal representatives to a number of other individuals and organizations.
Gia Lai Provincial Tax Department also conducted a review of individuals involved in the decision to exempt land rent for An Khe - KaNak Hydropower Company, a construction project in Kbang district, An Khe town.
In 2006, Gia Lai Provincial People's Committee reclaimed land and temporarily handed it over to this company for the project but did not require the investor to fulfill its financial obligations.
Gia Lai Provincial Tax Department issued a decision to exempt land rent for businesses, so there is a risk of losing more than 12.4 billion VND. This includes more than 8.2 billion VND in land rent and 4.1 billion VND in provisional late payment.
