Recently, public opinion has been stirred up by the incident in Ninh Giang district (Hai Duong province) of a mother buying and giving an electric motorbike to her son under 16 years old. While participating in traffic, the son caused an accident that injured 2 people. The mother was sentenced to 6 months in prison.
The trial attracted the attention of parents inside and outside Hai Duong province. This is also a topic that many parents are concerned about. Because if they do not give their children a vehicle, taking their children to school will be difficult, not every family has the means to take their children to school every day. However, giving a child a motorbike when they are not old enough will leave many unfortunate consequences.
Mr. Tran Van Duong (Tu Ky district, Hai Duong province) has 2 children who are both studying at a high school in the district. Mr. Duong invested in a car for each of his two children to facilitate their education. According to Mr. Duong, letting children go to school on their own will save a lot of parents' time and help children become more independent.
Contrary to Mr. Duong's point of view, Ms. Dao Thu Ha (Nam Sach district, Hai Duong province) said: "I am determined not to give my child a motorbike, even if I am so busy, my husband and I will take turns taking him to school. Giving a vehicle to a child when underage not only endangers one's own child but also affects others".

Recently, the Hai Duong traffic police force has coordinated with schools in the area to inspect the handover of parents' vehicles to students who are not qualified to drive vehicles. The Traffic Safety Committee of Hai Duong province has also proposed that the Department of Education and Training preside over and coordinate the organization of a pilot "no" model with giving vehicles to their children when they are not qualified to drive.
The Department of Education and Training of Hai Duong province has directed and guided educational institutions to require students to travel by car to school to register their own vehicles and types with the school to coordinate with local police and functional forces for inspection and management. Require households that keep vehicles around the school area to commit not to look after or keep motorbikes over 50 cm3 of students.
Clause 10, Article 32 of Decree 168/2024/ND-CP stipulates as follows:
Fines from VND 8,000,000 to VND 10,000,000 for individuals, from VND 16,000,000 to VND 20,000,000 for organizations that are owners of motorbikes, mopeds and similar vehicles, similar vehicles to mopeds that violate the act of handing over or allowing unqualified people according to the provisions of Clause 1, Article 56 of the Law on Road Traffic Order and Safety to drive vehicles on the road (including cases where the driver of a vehicle has a driver's license but is in the period of being revoked).
People aged 18 and over are allowed to drive a 110cc motorbike if they meet the prescribed conditions. People from 16 years old to under 18 years old are only allowed to drive a maximum of 50cc motorbike. Thus, from 2025, if parents give their children a vehicle that is not old enough to drive a 110cc motorbike, they can be fined from VND 8,000,000 to VND 10,000,000.
