In 2024, Da Nang City had 593 road traffic accidents, killing 132 people and injuring 557 people. Compared to the same period in 2023, there was an increase in all three criteria: an increase of 42 traffic accidents, an increase of 21 deaths and an increase of 48 injuries. Therefore, the authorities always increase patrols, control, promptly detect and handle violations of traffic safety and order. However, currently in Da Nang City, there is still a situation of encroachment on the sidewalk for business and trading, especially in markets such as Hoa Cuong unit market (Hai Chau district), Hoa Khanh market (Lien Chieu district). In addition, many families and units also encroach on the street to organize funerals and events.
For example, in early December, at a house on Huynh Ly Street (Thuan Phuoc Ward, Hai Chau District), a household set up a wedding tent in the middle of the street, obstructing traffic. Then, on December 3, when a garbage truck passed by, the household did not allow the truck to collect the garbage. According to the Hai Chau District People's Committee, this unit has assigned the Thuan Phuoc Ward People's Committee to inspect and handle the situation.
Based on citizen feedback, Thuan Phuoc Ward People's Committee directed the Urban Rules Team to work with the household on Huynh Ly Street.
"Through work, it was determined that a household organizing a wedding encroached on Huynh Ly Street, but it has now been completely dismantled. The Ward People's Committee has worked with the residential group and requested to remind people about this issue," said the People's Committee of Thuan Phuoc Ward.
Speaking with Lao Dong Newspaper, Lawyer Le Xuan Canh, CTT Law Firm and Associates, Da Nang City Bar Association, said that Decree No. 165/2024/ND-CP of the Government does not specify the criteria for granting temporary use permits for roads and sidewalks, but the use of roads and sidewalks for other purposes can only be carried out when there is a traffic organization plan, does not cause traffic congestion or has a traffic diversion plan.
Regarding the responsibility of local authorities - the competent licensing authority, after approving the temporary use of sidewalks and roads for purposes other than traffic, as prescribed in Clause 7, Article 21, Decree No. 165/2024/ND-CP of the Government.
"The need for people and organizations to temporarily use roads and sidewalks, such as setting up tents to hold funerals and weddings, exists in reality and is completely legitimate. Therefore, people and organizations that need to temporarily use roads and sidewalks for other purposes such as funerals and weddings, can apply for a license so that the competent authorities can consider granting a license and from there implement measures and plans to ensure traffic safety. Avoid unfortunate incidents regarding life and health safety as reported by the media in the recent past," said Lawyer Le Xuan Canh.
According to Lawyer Le Xuan Canh, local authorities need to promptly disseminate and guide people and organizations when applying for permission when people need to use temporary sidewalks and roads. From there, they will fully comply as well as regularly inspect and strictly handle cases of intentional violations according to the provisions of the law.
