Case content: At about 7:15 am on January 27, 2026, at Thien Cuong phone shop in Tam Tuong village, Ninh Giang commune, P.H. N (born June 27, 2009) secretly appropriated property from Mr. C, including: 2,600,000 VND, 1 Iphone 8 Plus phone, 1 charger and 1 charger cable. The total value of the appropriated property is 3,860,000 VND. P.H. N's actions constitute the crime of "Theft of property" as prescribed in Clause 1, Article 173 of the Penal Code.
During the investigation, the prosecuting agency determined that P.H. N was a minor, with limited legal awareness, committed the crime for the first time, the value of property was not large, had honestly confessed, repented, and his family had conditions to coordinate management and education. The defendant had a basic normal learning and living process in the locality, had harmonious relationships with teachers and friends, and had never shown any serious individual signs or violated discipline.
The defendant is in 11th grade, this is the first time committing a crime due to the momentary nature, without prior planning. The property theft situation was due to seeing that the property of the phone shop was negligent, there was no one to watch over, and many people came in and out to play games. P.H. N became greedy and committed the property theft. The defendant remedied all damages, and the family filed a request to apply redirected handling measures. Based on that, based on the provisions of the Law on Juvenile Justice, the People's Procuracy of Region 13 - Hai Phong opened a meeting to comprehensively consider the conditions for application.
At the end of the meeting, based on a comprehensive review of the documents in the file, the presentations of social workers, defenders, legal representatives of the accused, and prosecutors, the People's Procuracy of Region 13 decided to apply measures to redirect education in communes, wards, and special zones for P.H. N for a period of 6 months. At the same time, the measure to prevent prohibition from leaving the place of residence was cancelled.
Thereby, demonstrating the humanitarian and progressive policies of the law for juvenile offenders, contributing to preventing law violations and maintaining social order and safety in the locality.
