Article 48 of the Law on Fire Prevention, Fire Fighting and Rescue 2024 stipulates compulsory fire and explosion insurance as follows:
1. Agencies, organizations and individuals must participate in compulsory fire and explosion insurance for assets of establishments on the list of establishments that must purchase compulsory fire and explosion insurance and comply with the provisions of the law on insurance.
2. Encourage agencies, organizations and individuals to participate in compulsory fire and explosion insurance for assets of facilities not on the list of facilities that must purchase compulsory fire and explosion insurance.
3. The Government stipulates the list of establishments that must purchase compulsory fire and explosion insurance; deduction levels, management regimes, and use of revenue from compulsory fire and explosion insurance for fire prevention, fire fighting, rescue and relief activities.
Article 35 of Decree No. 105/2025/ND-CP detailing a number of articles and measures to implement the Law on Fire Prevention, Fire Fighting and Rescue stipulates compulsory fire and explosion insurance as follows:
1. Facilities on the list specified in Appendix VII attached to this Decree must purchase compulsory fire and explosion insurance for the assets of the facility, except for facilities under the management of the Ministry of National Defense and the Ministry of Public Security for military, defense, security and order purposes. Encourage other facilities to buy compulsory fire and explosion insurance.
For facilities with assets on the list of state secrets, special assets, specialized assets, assets serving state management, insurance providing enterprises must ensure security, safety, and confidentiality requirements in the process of providing compulsory fire and explosion insurance services.
Clause 1, Appendix VII List of establishments that must buy compulsory fire and explosion insurance (attached with Decree No. 105/2025/ND-CP), including Apartment buildings, collective housing with houses of 5 floors or more or a total floor area of 1,000 m2 or more.
Thus, from July 1, 2025, apartments with 5 floors or more must buy compulsory fire and explosion insurance according to the above regulations.
