Clause 1, Article 9 of Decree No. 03/2026/ND-CP Regulating the organization and operation of social funds and charity funds (effective from March 1, 2026), stipulates the powers and obligations of the fund as follows:
1. Fund authority:
a) Organizing and operating according to the law and regulations that have been recognized by competent state agencies;
b) Mobilizing donations and sponsorships for the fund; receiving assets sponsored, donated, or given by domestic and foreign individuals and organizations or in other forms in accordance with the principles and purposes of the fund and the provisions of law. Organizing activities in accordance with the law to preserve and increase the fund's assets;
c) Establish and manage organizations with legal entity status directly under the fund in accordance with legal regulations and the fund's charter to perform tasks, in accordance with the principles, purposes, and fields of operation of the fund;
d) Be entitled to complain according to the provisions of law;
e) Coordinate with localities, organizations, and individuals to develop and implement projects, programs, and funding plans in accordance with the law and the fund's charter.
Thus, from March 1, 2026, the charity fund has the above rights.
