Khanh Hoa responds to petitions on sanctioning residence registration for children

Khanh Hoa - Voters are concerned about the content related to administrative sanctions for cases of not registering residence for children within the prescribed time limit.

Khanh Hoa Provincial People's Committee has just issued a document responding to voters' petitions sent before the 3rd Session of the 7th Provincial People's Council, term 2021 - 2026.

According to voters' reflections in Phuoc Hau commune, parents may be fined from 500,000 VND to 1 million VND if they do not register permanent residence for their children within 60 days from the date of birth registration.

However, many cases of children born in the period from 2020 to before 2025 have not completed birth registration or residence registration due to objective reasons such as lack of legal knowledge, difficult travel conditions...

Voters proposed that competent authorities consider only applying penalties to cases arising after 2025.

Khanh Hoa Provincial People's Committee said that according to current regulations, within a maximum of 60 days from the date the minor is registered for birth registration, the father, mother, head of household or guardian is responsible for carrying out procedures for permanent or temporary residence registration or declaration of residence information for the child.

In case this time limit is exceeded and not implemented, a warning or a fine of 500,000 VND to 1 million VND may be applied.

Khanh Hoa Provincial People's Committee said that the violation being committed is an act that continues at the time the competent authority detects it and still infringes upon state management order.

Therefore, for cases where children have been registered for birth before January 10, 2025, but have not yet been registered for residence and the violation is still ongoing, considering handling according to current regulations is appropriate.

However, Khanh Hoa Provincial People's Committee requests that the handling must ensure reasonableness, logic and compliance with regulations.

For cases of first-time residence registration for children overdue for 60 days due to objective reasons, not originating from citizens' faults, competent authorities will consider applying regulations on mitigating circumstances or cases not sanctioned according to the Law on Handling of Administrative Violations.

Notably, from December 15, 2025, Decree No. 282/2025/ND-CP has supplemented the main penalty form as a warning for violations of registration and management of residence.

Based on specific dossiers and relevant legal regulations, commune-level police will choose appropriate forms of handling, especially for cases of non-serious violations and mitigating circumstances.
