Regarding this petition, on the Electronic Information Portal, the Ministry of Home Affairs has responded. The Ministry of Home Affairs said that perfecting policies and laws on beliefs and religions to suit the new situation is a requirement in the state management of beliefs and religions that the Ministry of Home Affairs has always asked. Therefore, after 3 years of implementing the Law on Belief and Religion (Law) and Decree No. 162/2017/ND-CP dated December 30, 2017 of the Government detailing a number of articles and measures to implement the Law on Belief threshold and religion (Decree No. 162/2017/ND-CP), the Ministry of Home Affairs has reviewed and summarized the shortcomings and problems in implementation to conduct a 3-year preliminary plan for implementing the Law and Decree. No. 162/2017/ND-CP in 2021; advised the Government to promulgate Decree No. 95/2023/ND-CP to replace Decree No. 162/2017/ND-CP to resolve some inadequacies and problems in the implementation process.
Regarding regulations on land and construction of belief and religious works, when it is discovered that the provisions of the Law on Belief and Religion are not synchronized with relevant laws (land, construction, health , education...), the Ministry of Home Affairs assigned the Government Committee for Religious Affairs to review and report; In case of necessity, they will synthesize and coordinate with relevant ministries and branches to resolve or submit to competent authorities for consideration and resolution according to the provisions of law.
Regarding the promulgation of the Decree on sanctioning administrative violations in the field of belief and religion (Decree on Sanctions): After the Law on Belief and Religion was passed by the XIV National Assembly on November 18, 2016, the Ministry of Home Affairs The Department has advised the Government to develop a Decree on Sanctions and has fully implemented the steps to develop and complete the draft. The Ministry of Justice has conducted an appraisal of the draft dossier.
However, because there is still much feedback on the social impact and effectiveness of the Decree's promulgation; Especially in cases where the subjects being punished are dignitaries, officials, monks... it will create bad public opinion in society; vulnerable to being exploited by hostile forces to distort freedom of belief and religion; affecting the great national unity bloc.
Therefore, the Ministry of Home Affairs has reported to the Government to allow adjustment of the time for promulgating the Decree on Sanctions after summarizing the implementation of the Law (expected in 2025).
