Supplementing regulations on intellectual property protection for virtual assets and artificial intelligence

The draft amends and completes regulations on subjects to protect the entire industrial style of user interface design and virtual assets.

Continuing the 10th Session, on the afternoon of October 27, Minister of Science and Technology Nguyen Manh Hung, authorized by the Prime Minister, presented the draft Law amending and supplementing a number of articles of the Law on Intellectual Property (SHTT).

Minister Nguyen Manh Hung mentioned the policy of "updating new issues in SHTT protection in the world in accordance with the policies and level of socio-economic development of Vietnam".

Accordingly, amending and perfecting regulations on subjects eligible for industrial design protection (to protect the entire industrial design for user interface design, virtual assets).

Regarding the reason, Minister Nguyen Manh Hung said that it is to create a complete and clear legal basis to protect industrial property rights for virtual assets and design user interfaces.

Regarding the new content, supplement regulations to protect patents for computer programs, algorithms, and business methods in some specific cases, and protect trademarks related to national geographical indication (Articles 59, 74).

Supplementing regulations to protect SHTT rights for virtual assets, issues related to artificial intelligence to handle issues arising from new trends in technology and innovation, digital transformation (Articles 4, 7, and 22,).

This is to create a clear legal basis to handle some issues arising from new trends in technology development, innovation and digital transformation.

Another content is the policy of "supporting the creation and commercial exploitation of SHTT rights subjects to promote innovation".

Amend and perfect the concept of SHTT rights. Clarifying the state management of SHTT including raising awareness, exploitation capacity, and developing SHTT rights subjects.

Amend and complete regulations on cases of limiting copyright and related rights in broadcasting activities; on the right to register SHTT, and commercial exploitation of these rights for the results of science and technology tasks using the state budget.

Amend and improve regulations against abuse of the monopoly of SHTT, abuse of measures to protect SHTT rights.

The reason is to create a legal basis to promote the commercial exploitation of SHTT rights, ensuring compliance with civil law and international commitments.

Regarding the new content, supplement the regulation on handling conflicts of access rights to facilitate commercial exploitation (Article 7).

Supplementing contents on the State's policies in supporting the creation and commercial exploitation of SHTT rights to promote innovation.

Accordingly, support the creation, establishment, exploitation, management and development of subjects of SHTT rights; support the evaluation and application of SHTT rights transfer models, SHTT rights sharing mechanisms; The State prioritizes the purchase of SHTT rights for important subjects of national security, economy and society.

Pioneering the ordering, purchasing and using products and services created on the basis of applying computer programs, inventions, arranging designs, and plant varieties created in Vietnam; supplementing policies to develop the SHTT ecosystem, encouraging organizations and individuals to invest in startups.
