On the morning of September 4, the National Assembly Standing Committee gave opinions on the draft Law amending and supplementing a number of articles of the Labor Code, the Law on Archives, the Law on Gender Equality, the Law on Red Cross Activities and the Law on Employment.
Presenting the draft Law, Deputy Minister of Home Affairs Cao Huy said that for the Labor Code, the Government proposes to institutionalize the new content of Resolution 80 of the Politburo on the development of Vietnamese culture.
Accordingly, the draft Law stipulates that November 24 is "Vietnamese Culture Day" and is a holiday, employees are entitled to full salary.
The Government also proposes to amend and supplement regulations on announcing holidays and Tet holidays annually to ensure consistency with regulations on decentralization and decentralization. Specifically, the holiday and Tet schedule of the following year must be announced before September 30 of the following year, based on the Prime Minister's decision advised by the Ministry of Home Affairs.
The Deputy Minister of Home Affairs said that this regulation aims to create conditions for officials, civil servants, public employees, people and businesses to prepare appropriate programs and plans, avoiding notification close to holidays, causing difficulties for people and businesses in holidays and Tet holidays as they are now.
The draft Law is expected to be submitted by the Government to the National Assembly for consideration and approval at the Second Session (October) and take effect from March 1, 2027, except for the content on "Vietnamese Culture Day" taking effect from the date the National Assembly passes it.
Thus, after being proposed for supplementation, according to regulations, employees are entitled to leave work and receive full salary on holidays and Tet. Specifically, New Year's Day 1 day (January 1st of the lunar calendar), Lunar New Year 5 days, Southern Liberation and National Reunification Day 1 day (April 30th of the lunar calendar), International Labor Day 1 day (May 1st of the lunar calendar), National Day 2 days (September 2nd of the lunar calendar and 1 consecutive day before or after), Hung Kings Commemoration Day 1 day (March 10th of the lunar calendar) and Vietnam Culture Day 1 day (November 24th of the lunar calendar).
After verification, Member of the Party Central Committee, Chairman of the Culture and Social Affairs Committee Nguyen Dac Vinh said that regarding holidays and Tet, the Standing Committee agreed with the regulation to add 1 day off as "Vietnamese Culture Day" (November 24th of the solar calendar), employees are allowed to take leave from work and receive full salary.
Some opinions suggested regulating the principle of converting holidays and Tet holidays so that people and businesses can be proactive in their work.
Concluding this content, Member of the Party Central Committee, Vice Chairman of the National Assembly Nguyen Thi Thanh said that the National Assembly Standing Committee agreed to add November 24th as Vietnam Culture Day as a full-wage holiday. It is proposed to review and unify the application time.
At the same time, consider and study whether it is necessary to stipulate in the law the authority of the Minister of Home Affairs to notify the annual holiday and Tet schedule, the notification deadline, or for the Government to assign according to its authority.
