Application for pension of compulsory social insurance participants

The Lao Dong Newspaper Legal Consulting Office replied:

Article 77 of the Law on Social Insurance 2024 (effective from July 2025) stipulates the application for pension for compulsory social insurance participants as follows:

1. The pension application for those participating in compulsory social insurance includes:

a) Social insurance book;

b) The original or copy of the document determines the termination of the labor contract or the written termination of the work or the proposal of the object specified at the points G, H, M and n, Clause 1, Article 2 of this Law.

2. The pension application for those who are reserving compulsory social insurance payment period includes:

a) Social insurance book;

b) Proposal document of the person who is reserving the compulsory social insurance payment period.

3. The case specified in Article 65 of this Law, in addition to the dossier specified in Clause 1 of this Article, there is an additional record of an assessment of the working capacity decrease of the Medical Examination Council or a copy of the certificate of severe and particularly severe disability level that may show the conclusions of the Medical Examination Council, clearly stating the percentage of labor capacity reduction.

4. In the cases specified in Point d, Clause 1 and Point c, Clause 2, Article 64 of this Law, in addition to the documents specified in Clause 1 of this Article, there must be a copy of the certificate of HIV infection due to occupational accidents.

Thus, from July 2025, the pension application for compulsory social insurance participants is regulated as above.
