Article 12 of Decree 158/2025/ND-CP (effective from July 1, 2025) stipulates the conditions for pension benefits as follows:
The conditions for pension benefits are implemented according to the provisions of Articles 64 and 65 of the Law on Social Insurance and are specified in detail as follows:
1. Coal mining in mines according to Appendix I issued with this Decree.
2. When determining the pension conditions for cases where the employee's application does not specify the date and month of birth but only the year of birth, the January 1st of the year of birth will be used as the basis for determining the employee's age. In case the date of birth cannot be determined but only the month or year of birth is used as the basis for determining the age of the employee.
3. When determining working time in a place with a regional allowance coefficient of 0.7 or higher for working time before January 1, 1995 as a basis for considering pension conditions, it shall be based on the provisions of law on regional allowances at the time of settlement. For areas where the law on regional allowances at the time of settlement does not stipulate or stipulate a regional allowance coefficient lower than 0.7 but the employee has actually worked in a place with a regional allowance coefficient of 0.7 or higher as prescribed in previous documents regulating regional allowances, the provisions of those documents shall be used to determine the working time in a place with a regional allowance coefficient of 0.7 or higher as a basis for considering pension eligibility.
In case the employee has worked at battlefields B and C before April 30, 1975 and at battlefield K before August 31, 1989, which is counted as the period of social insurance payment, this period will be counted as working time in a place with a regional allowance coefficient of 0.7 to serve as a basis for considering the conditions for pension.
4. Subjects specified in Point d and Point d, Clause 1, Article 2 of the Law on Social Insurance who are stripped of military titles or the title of People's Public Security shall be eligible for pension in accordance with the provisions of Clause 1, Article 64 and Clause 1, Article 65 of the Law on Social Insurance.
Thus, the regulations on pension conditions under the Social Insurance Law 2024 are implemented as above.
