According to the Decision of the People's Committee of Ca Mau City, 30 working days have passed from the date of issuance of the decision to sanction administrative violations, Mr. Ho An Tap did not carry out land procedures, causing difficulties in local state management and reduced people's trust in the government.
To ensure the implementation of Decision No. 82/QD-XPHC dated January 9, 2023 and Decision No. 7309/QD-SĐBSHB dated November 15, 2023 of the Chairman of Ca Mau City People's Committee on amending and supplementing part of the Decision on sanctioning administrative violations. For Mr. Ho An Tap, Ca Mau City issued a decision to enforce. The time limit for implementing remedial measures is 15 days from the date of receipt of the decision.
According to the Enforcement Decision, Mr. Ho An Tap must take remedial measures due to administrative violations specified in Clause 2, Article 11 of Decree No. 91/2019/ND-CP dated November 19, 2019 of The Government regulates penalties for administrative violations in the field of land.
Converting aquaculture land to non-agricultural land in rural areas without permission from a competent authority, violation area is 3,564.8 m2, violation location is in Tan Thanh commune, Ca Mau city.
Remedial measures: For the area of 2,261.58m2, apply point a, clause 4, article 11 of Decree No. 91/2019/ND-CP, forcing the restoration of the original condition of the land before the violation. For the area of 1,303.22m2, apply point a, clause 4, article 11 of Decree No. 91/2019/ND-CP, forcing the restoration of the original condition of the land before the violation (according to the drawing of the current state of the land plot provided by Tan Thanh Commune People's Committee).
Within 15 days from the date of receiving the Decision, Mr. Ho An Tap must comply with the Decision. If the time limit exceeds, Mr. Ho An Tap does not voluntarily comply, he will be forcibly executed according to the provisions of law. Mr. Ho An Tap has the right to complain or initiate an administrative lawsuit against this Decision according to the provisions of law.
As Lao Dong informed, after the Facebook account "Ho Tap" continuously posted images and livestreams of the construction process of the project introduced as "the most beautiful building in Ca Mau", Ca Mau City authorities It was discovered that this building was built on land planned for aquaculture and the building owner was fined for administrative violations.
According to the decision to sanction administrative violations, Mr. Xi committed the administrative violation of "converting aquaculture land to non-agricultural land in rural areas without permission from competent state agencies" and was fined 22.5 million VND and forced to restore the original condition of the land before the violation.
On April 12, the People's Committee of Ca Mau City issued Decision No. 195/QD-UBND, allowing Mr. Xi to change the land use purpose from aquaculture land to rural residential land, area 583.20m2, land plot No. 672 and 673, map sheet number 1, in Tan Thanh commune, Ca Mau city (long-term use). After receiving the decision, Mr. Tap and his wife contacted the one-stop department of Ca Mau City People's Committee to submit documents and carry out procedures to change the land use purpose.
In response to the request of the owner of "the most beautiful building in Ca Mau", the People's Committee of Ca Mau City said that the specialized agency has not yet implemented Decision No. 195/QD-UBND dated April 12 of the People's Committee of Ca Mau City to him and the People's Committee of Ca Mau City. revoke and cancel Decision No. 195/QD-UBND. Therefore, Mr. Xi's request to be implemented according to Decision 195/QD-UBND is unfounded because the Decision has not yet been deployed to him by the competent authority and has been revoked and canceled.
