According to new regulations in the Law on Social Insurance (BHXH) 2024, people who are receiving pensions or monthly social insurance allowances are fully entitled to request to change the form of receiving money or the place of receipt when needed.
Specifically, Article 82 of this law clearly stipulates: people who are receiving monthly pensions and social insurance allowances if they want to change the form of receipt (for example, from receiving cash to receiving through a bank account or vice versa) or change the place of receipt due to moving residence in the country, they must have a written document sent to the social insurance agency where they are paying.
After receiving the request, within 05 working days, the social insurance agency is responsible for considering and resolving it. In case it does not resolve it, this agency must respond in writing and clearly state the reason.
Thus, when there is a need to change the form of pension receiving, the beneficiary needs to proactively send a written request to the social insurance agency that is paying to be resolved according to regulations.
Deadline for submitting applications for pension benefits according to new regulations
According to the provisions of Clause 1, Article 79 of the 2024 Law on Social Insurance, the deadline for submitting applications for pension benefits for employees participating in compulsory social insurance is specifically determined before the time of eligibility.
Within 20 days before the time the employee is eligible to receive a pension, the employer is responsible for submitting the dossier as prescribed in Article 77 of this Law to the social insurance agency.
For cases where employees are preserving the compulsory social insurance contribution period, employees must directly submit the dossier within the same 20-day period before meeting the conditions to receive a pension.
In addition, the law also stipulates the time limit for resolving dossiers. Accordingly, within 20 days (excluding holidays and Tet) from the date of receiving complete dossiers for pension applicants, the social insurance agency is responsible for resolving. In case of non-resolution, it must respond in writing and clearly state the reason.
Thus, employees participating in compulsory social insurance need to pay attention to the 20-day deadline before meeting the conditions to receive a pension to submit dossiers in accordance with regulations, avoiding affecting their rights.
