Clause 1, Clause 2, Article 75 of the 2024 Law on Social Insurance has detailed the cases of temporary suspension and termination of monthly pension and social insurance allowance enjoyment.
Cases of temporary suspension or termination of pension and allowance benefits
Temporarily suspending the enjoyment of pensions and monthly social insurance allowances for people who are receiving them in 1 of the following cases:
- Illegal exit.
- Declared missing by the Court.
- When information about the beneficiary cannot be verified.
Cases of pension and allowance termination
Terminating the enjoyment of pensions and monthly social insurance allowances for people who are receiving them when they fall into one of the following cases:
- Death or being declared dead by the Court.
- Refuse to receive monthly pensions and social insurance allowances in writing.
- The conclusion of the competent authority on enjoying social insurance is not in accordance with legal regulations.

Cases of continuing to receive pensions after being stopped from enjoying them
Based on Clauses 1 and 2, Article 75 of the 2024 Law on Social Insurance, cases of pension suspension in Section 1 will continue to be paid in the following cases:
For the monthly pension of the subject specified in Section 1.1 and who dies or is declared dead by the Court:
Continue to be paid when falling into one of the following cases:
- Illegally exited person returning.
- Having a decision of the Court to cancel the decision declaring missing or the decision declaring dead.
- Subject Clause (iii) Item 1 has verified information according to regulations.
Pensions include pensions and monthly social insurance allowances for the period of time not yet received.
For cases of refusing to receive a pension in writing:
Continue to be paid from the time the social insurance agency receives a document requesting to re-receive pensions and monthly social insurance allowances and does not include pensions and monthly social insurance allowances from the time they have not received due to refusal to receive.
Note, specifically for subjects who are temporarily suspended from enjoying pensions and allowances and people declared dead by the Court to continue to be paid, including monthly pensions and allowances for the time they have not received if they fall into 1 of the following cases:
- Illegally exited person returning.
- Having a decision of the Court to cancel the decision declaring missing or the decision declaring dead.
- In case of temporary suspension of pension benefits due to failure to verify information, beneficiaries will continue to be paid when verifying information about benefits with the social insurance agency or service organization authorized by the social insurance agency.
