The Ministry of Construction will collect opinions until September 1, 2025 on the draft Decree on Regulations on administrative sanctions for violations in the road sector.
Notably, Article 25 of this draft Decree stipulates amending and supplementing a number of articles of Decree No. 100/2019/ND-CP dated December 30, 2019 of the Government regulating administrative sanctions for violations in the field of road and railway transport.
Article 25 of the draft stipulates: abolishing a number of Articles of Decree No. 100/2019/ND-CP as follows: Articles 5, 6, 7, 8, 9, 10, 11, 12, 13, 14, 15, 16, 17, 18, 19, 20, 21, 22, 23, 24, 25, 26, 27, 28, 29, 30, 32, 33, 34, 35, 36, 37. 38.
Abolish points a, b, c, d, d, e, g, f, h, l, m, m, o, p, q, Clause 5, Clause 6, Article 74.
Repeat Clauses 3 and 6, Article 80.
Comparing Decree No. 100/2019/ND-CP, some articles proposed to be abolished as follows: Some regulations on penalties for drivers of cars and motorbikes (as stipulated in Decree 168/2024/ND-CP).
Remove some provisions of Clause 5 and Clause 6, Article 74 on the determination of the authority to impose administrative sanctions in the field of road and railway transport (the authority of the inspectorate of transportation, maritime ports, airports, inland waterway ports).
Some regulations in Article 80 on penalties for vehicle owners and drivers who violate regulations related to road and railway traffic.
